I got my conditional GC through AOS. I have a son 17 years and PR of Canada. My wife is USC. My son does not want to live with his mother (Canada) any more. He is here in the US of B2 visa. He has decided to stay on in the USA after coming here and not move back to Canada.

My question is how much time does it takes for the two options, DCF (Vancovuer) and if I apply for AOS here in the US only. He has been here for more than 2 months. He has made this decision in the last week. His mother has consented for the move. Also briefly, indicate the steps and the time lines for the same. Please do not include the SC time lines as I am aware of them.

Thanks in advance,

Your wife can file for your son and since he's under 21, and she is a USC he wouldn't wait longer than a year. He would be considered as an immediate relative which have no wait time. I was over 21 when my stepfather filed for me, and i had to wait 6 years before i could apply for a visa. Someone will come along to help you, and correct me if i'm wrong.
