Serious trouble, need some help please!

I came here on F1 visa in 2008 and it got expired. I got married this year in June and everything was going good, it was a love marriage but all of sudden my wife patched up with her ex boyfriend and start giving me trouble and now she is got pregnant by her ex two months ago and she's going to keep his baby. She left me and now staying with her ex. My life is really messed up right now and I don't know what to do. They are threatening me like they are going to call police on me if I do something and they will deport me back to my country and much more. I'm going through a lot right now. I feel like I'm done with my life.

I am sorry but your story sounds strange,why whould they threat you?what can you do against them?NOTHING.

Unfortunately nothing can be done as your path to residency lies with your wife. If she refuses to attend your marriage interview or abandons the process it's all over and you'll be eventually denied and asked to leave the U.S. as you have no legal status at the moment to keep you in. Would've been a total different story had you been on valid F1 status.

When I said they started giving me a trouble, I meant that my wife have abused me, slapped me and his boyfriend punched me on my face and I have the police report on that. Since my wife knows that I have no legal status, she have threaten me that she will get me deported. She has also said that if I take any legal action on her abuse and stole my money, she would send her boyfriend to F**meUP. I have got restraining order against her. Her boyfriend has been calling me and telling me that I have to leave this state or country otherwise he would kill me. My life has been so misreable, and dont know what to do now. I am so depressed.

OP how is your life doom if you have to go home? I am afraid you will have to go

and why would they threaten to call the police on you? it seem if its a simple as

you told it she would have felt bad , walked away & file a divorce (she probably did)

However, because the self-petitioner has to prove the abuse as well as the legitimacy of the marriage, gathering all the required evidence might take longer.

So yes, it's possible to file for an AoS under VAWA, but proving your case is another story.

You need to be able to prove a bona fide marriage to be able to file under VAWA.
