Hi,

I just read another thread regarding 2006 taxes. We had our taxes done early and have our refund. We were only going to send in 2003, 2004, 2005 taxes because we read on VJ somewhere that if it's before April 15th, the prior year taxes aren't required. The only reason we were going to exclude 2006 is that we filed as married (she's a USC and I'm here on a TN visa) and we're not sure if the 1040 should go with her I-864 or my I-864A or both? (we're also using my income toward the poverty line amount... she's EXACTLY $387 SHORT!!!)... or both?!?!

We are filing "The Works" on March 15th!

Any advice or feedback on this would be appreciated!

If it's already filed, send the 2006 tax return. I filed mine a few days after sending our AOS in (wasn't planning on it, got a huge unexpected bill and needed it) and am expecting to get an RFE as people who hadn't filed taxes yet have gotten RFE's for it.

I don't know what a TN visa is, but make sure your income is allowed to be used toward the 125% of the poverty line figure.

aos timeline:

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

but since we filed jointly as married, does she file the 1040 with her I-864 or with my I-864A or both? Did you file as a couple or individually?

Oh, by the way, A TN visa is under NAFTA for Canadian and Mexican citizens who qualify under the guidelines to accept work in the US.

Mine was individual because we didn't marry until January 5th (my mom wanted the education credits from last year, hah) - I would imagine you'd file it with both, since your income is being used and you live in the same household. I'm not sure, though, so I'd wait for someone who knows better.

1040 goes with the I-864 if you filed jointly and live together. No need to include it with I-864A, in fact its not clear that I-864A is even needed for spousal income, but it doesn't hurt to include it anyway.

Ive been thinking about the notion we've tossed around here about the current tax form requirement. I think we've all been under the assumption that since the law doesnt require us to file our taxes before the April 15 deadline that also should mean the USCIS, NVC and consulates shouldn't require it to be our most recent tax filing.However, many people have received an RFE for this years taxes. My new school of thought on this issue is this; employers , banks, govt agencies etc are required to have tax information to the tax payer by Jan 31 therefor Im thinking that would be the deadline date for most current tax filing.......From Jan 31 forward. Just because we choose not to file our taxes doesnt mean we lack the ability to do so.

Oh and if this has been discussed somewhere else , I certainly haven't seen it , but if it has just pretend I didnt post lolololol
