I really dreaded this feeling. For some reason I knew we will get hit by RFE, but I didn't expect to panic this much.

In their RFE letter they pretty much said that our bank statements weren't complete, and we need more evidence of financial co-mingling and ownership and stuff. And then of course they included the entire list of what's a good evidence for ROC.

So as I'm preparing to mail my response tomorrow, I got a terrible panic attack, because 90% of the stuff I'm mailing them, we already mailed back in April.

Guys, I really need your best advice now. Here is what I'm sending them tomorrow:

- full bank statements from 2013-2015 showing joint bank account (in April just sent the first page of bank statements)

- tax returns for 2013 and 2014 (copied every page that was sent to us by our accountant)

-copies of two bills of sale for cars showing joint ownership

-home owner's insurance for 2014 and 2015

-car insurance for both of our cars 2013-2015

-medical insurance 2013-2015

-travel itinerary of our trip to Dominican last year

-statements that I'm beneficiary to all of my husband's retirement and investment account

-4 affidavits, 2 of them are my husband's sisters, and 2 of them are friend and neighbor (affidavits aren't notarized)

-paper showing that my husband was my emergency contact and transport home after last year's surgery

-paper showing my husband as my number one contact from my university

-american express statements showing both of our names

-utility bills from 2013-2015

-phone bills with the paper showing we can only access 2014-2015 and would have to pay to access earlier records (thanks AT&T)

-itinerary showing we are going to spend holidays with his family

-about 70 photos

-scan of our licenses

-copy of the lease agreement from the apartment we lived at even before marriage

In the cover letter we explained that I'm not on the house title because when my husband was purchasing our home, I didn't have SSN.

Do you guys think that this is good enough, or am I panicking for a good reason?

If there is something similar you experienced let me know how you responded.

I really appreciate it!

Did you just not send a full set of bank statements the first time? You're sending them a lot - don't panic, this'll probably be fine. Worst case, they'll call you for an interview - but if it was just missing statements, then that'll clear things up.

As has been mentioned in numerous recent ROC RFE threads, a few are mentioned below:

http://www.visajourney.com/forums/topic/571697-urgent-envelope-to-be-used-to-send-roc-application-and-documents/

http://www.visajourney.com/forums/topic/572609-what-if-our-rfe-isnt-enough-automatic-denial/

http://www.visajourney.com/forums/topic/568528-rfe-for-roc/page-2

Include ALL documents/statements since the inception of the marriage. Affidavits are weak evidence. Numerous folks (including ourselves) that included wills, DPOAs, Living wills had success with submission of such documents. YMMV.

There is no need for panic. Systematically address each RFE issue to the best of your ability.

Good luck on your immigration journey.

No I didn't. We sent only the front page showing both of our names. This time I printed all 12 pages of each bank statement for last two and a half years.

Pitaya,

it is because of reading those topics that I'm panicking. I see that we did things wrong the first time, so I'm afraid they will really nitpick our stuff because of it now. I don't know what to think anymore. I'm scared and confused.

Relax some.

In addition to your planned evidence, consider crafting wills, medical powers of attorney, and similar documents. These make excellent evidence for ROC, and they're even more crucial to have in "life."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

TBoneTX,

I'm trying to relax but it is hard. As far as advance directives, I know how important they are, as I'm currently completing my Bachelor's in Healthcare Administration. However, here is what doesn't make sense to me: how can something that is crafted today hold more power over me being literally beneficiary to every single investment and retirement account for the last two years?

I'm trying to put myself in a position of an immigration officer and how would I react if I saw those two in front of me. One shows financial assets for the last two years, and one was crafted today just for the sake of RFE.

I mean at this point, there is nothing else we have to present, and if it comes to that, we will go and have an interview. What really pisses me off is the fact that our beautiful, loving marriage is getting hard to prove because of stupid bills or similar.

arghhhhhhh........

Hi Mojo89,

Don't worry about it too much. Even folks (like me) that sent them a lot of stuff got an RFE. You can only send them what you have and what you're sending them now seems solid. Just send it and relax. RFEs are not as big a deal as we make them to be. All the best!

Agree! Trying to second guess or determine what the adjudicator is thinking is folly...... just do what we did.....send them every last little scrap of paper, 'cept the kitchen sink. For example, if you sent 2 of 12 pages of a statement before, send them ALL twelve pages, of ALL documents/statments since the inception of the marriage.

As mentioned in those previous threads, I sent in almost six (6) pounds of evidence initially, that resulted in an RFE "for more marriage bonafides since the inception of the marriage." So, we scraped everything together and sent in almost four (4) pounds of supplemental/additional RFE evidence (including wills, etc.), got our ROC approval within a week of ROC package acceptance.

Good luck on your immigration journey.

Good luck - with that list of evidence, sounds like you'll be fine.

This was the tactic we took with our RFE. We sent everything we could possibly find - our initial package was about 5 lbs of paperwork.. .the additional evidence for the RFE was 10 POUNDS! 2 weeks after the RFE evidence was received, we got an approval letter for ROC. I have this mental picture of the agent opening that box, looking at all the paperwork (there was so much I had to put it into folders with tabs and a "directory" on top to cross reference each folder) and going "ok! ok! I surrender!" haha!

hahaha :D well, in April we really didn't send that much, and I joined visa journey a little late. So yesterday's package was sent in a box because it couldn't fit the envelope. And if that isn't enough, then we'll get the kitchen sink for the interview lol
