Patriotism is silly and stupid.

Two months ago when we crossed the border retiring from another country they gave her until January. She has since returned to Canada and tried to come back into the USA and the agent arbitrarily gave her a huge limit. Why should I be patriotic about a system that allows this? What rules are they going off of that they can't be consistent and direct me somewhere that clearly displays them? Why is it up to some specific officer and how they feel? These people aren't experts at lie detection and constitutional law.

What rules are they going off of that they can't be consistent and direct me somewhere that clearly displays them? Why is it up to some specific officer and how they feel? These people aren't experts at lie detection and constitutional law.

What is happening is that they are doing their jobs. It is their duty to make sure that people crossing the border are doing so in accordance with our laws--- and some of those include the fact that foreigners can't live and work here on tourist/visitors visas. They clearly have suspicion that she is attempting to live and work here (she told them as much once, and the ongoing relationship is a flag for potentially living here), and she doesn't have the clearance to do that. What would you have them do in this situation?

Also---why just the day trip to Detroit? Is that what you told them you were planning? Were you actually planning something else? If so, they probably could tell may be calling your bluff. Think of this as a test of her (and your) honesty. Fail it and you will have nothing but trouble down the road. And, frankly, you'll have no one to blame but yourself. I know that when it's personal and you know (or think) that you're not doing anything wrong, and especially if you're from a more privileged country it seems insane that you can't just do whatever you want. But you have to remember, that wealthy, friendly, special country or not, it is still a foreign country and most of those rules that apply to, say, Mexicans, apply to her, too (except the biggie-- she doesn't need a visa to enter which is a huge privilege that literally only Canadians have and if I were her I would be extremely careful to not lose it).

For what it's worth, this is in no way just a US thing. On 2 different trips to Costa Rica to visit my fiance, I was only granted the exact number of days I told the border agents I was planning to stay (normal is 90 days). They have a fairly significant problem with foreigners, Americans and Canadians in particular using tourist visas to de-facto immigrate, doing border runs to Nicaragua or Panama every 90 days. They don't like it for a variety of reasons but are mostly stuck with it, and every now and then they give people hassle at the border if they suspect that they are engaging in this "perpetual tourism" scheme.

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Perhaps the OP should strongly consider giving up his US citizenship, as he apparently has little regard for the laws of our country (and, BTW, our Constitution does not give YOU the right to decide how along an alien may be admitted to my country....I suggest you give it another read) nor its borders nor the people who protect them....but I say let's give him a chance....please, find that RIGHT in our Constitution that gives you the authority to decide how long an alien is to be admitted (or even admitted at all) to my country.....we are waiting for your learned reply.

Have you maybe considered that they're getting suspicious about her frequent visits? You do realize they're just doing they're job right? It's fascinating how many USC's do not respect the people protecting your country's borders.

What do you mean by "a system that allows this?". Do you mean that you're upset because the system is working? She is frequently going to the US and the CBP officer was nice and gave her a day trip to Detroit and you want to make sure that CBP never trust her again?

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
