My girlfriend is Canadian. She was denied entry into the USA 2 months ago because she said she was looking for a job. Fast forward to now, she brought documents to prove her ties to Canada and we got across the border. The officer gave the caveat that we are approved only for a day trip to Detroit. He specifically said that if we had wanted to stay longer he would deny her visit.

My question: can she simply ignore that caveat and come back with me to California for a few weeks? What repercussions would there be?

The problem is they arbitrarily placed a limit on her. They didn't follow the draconian laws, they have zero oversight and appeal process. The list goes on and on. Since you don't have person experience nor information, you can't be helpful.

was she issued an I94 at the border? Not uncommon for Canadians given a limited stay. In that case, no, she must return and abide by the terms of her I94

It is arbitrary but the border guards have the right - she (and you) would do better to follow their instructions - why would she want to risk being flagged more then she already obviously is...follow what they ask, show you can follow instructions. If someday your intent is to marry and have her move to the US, it would be prudent to not have a flagged record a mile long...or worse...a ban for a period of time.

Speaking from experience, if they give you a date to leave the country, it is in your best interest to leave by that date. Been there done that, I know it is tough but you have to follow the rules. If they know you have an ongoing relationship and are travelling to visit your siginificant other, they do tend to be tougher. I had lots of trouble going back and forth between Canada and the U.S and I am married to a U.S citizen and have U.S citizen children with my husband, they do not care (well they do to an extent, they are not completely heartless), but the laws of this country trump that. But yes, if she has one day, then that is the max time she should stay. The fear of what could happen if she doesn't follow the rules, outweighs the need of wanting to stay a little longer.

It warms the heart to hear from the unpatriotic ones....guys, this is the US of A, not some 3rd world cesspool....we have rules, and responsible adults are expected to abide by the rules and laws...what is so intellectually challenging about that concept?

Patriotism is silly and stupid.

Two months ago when we crossed the border retiring from another country they gave her until January. She has since returned to Canada and tried to come back into the USA and the agent arbitrarily gave her a huge limit. Why should I be patriotic about a system that allows this? What rules are they going off of that they can't be consistent and direct me somewhere that clearly displays them? Why is it up to some specific officer and how they feel? These people aren't experts at lie detection and constitutional law.
