Hi guys,

I am the USC(female) and my fiance is the k1 visa holder.

If we do get married, which is going to be soon, do i have to change my last name to his last name before submitting the AOS application.

OR

On the 1-485, how do i fill out my portion of the form (i.e Name)

I know this might sound as a stupid question but believe, i am at a loss on what to put there as the USC.

Any info will help.

I know i have to attach a PHOTOCOPY i think of the marriage certificate.

Hmm...forgive me if this is a stupid answer, but don't you have to file your I-485 *after* you are married? So are you going to change your last name to his once you are married? Maybe I'm confused... :unsure:

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

If you are taking his surname, then put this in as your surname. Marriage is a legal means of changing your last name, and the copy of your marriage cert(which you must include) shows this.

Oh, I see. :) Yes, there should be a place on the I-485 for you to put your name ((your 1st name and your new married last name)) and then another space where they ask for your maiden name, or as I think it is stated: any other names you have ever used in the past.

Does that make sense? Look on the form, I think you'll see what I mean. :thumbs:

There's no place for you to put your maiden name on the I-485 as you are the USC spouse. All mail will be mailed to your husband's name, so yours will not be a huge factor.

For your employer's letter, you should inform them of any name change so their letter can reflect this. Most of your recent pay slips and tax returns will obviously be in your maiden name - this is understandable as you have just gotten married. Your maiden name will also show on the marriage certificate. This is what ties your maiden and married name together.

sorry guys,

i was actually looking at the form 1-485 now and in section B,it says :"List your present husband and wife and if none put "NONE"."

Then it goes to FAMILY NAME, GIVEN NAME,MIDDLE INITIAL E.T.C.

This was the part i was talking about-THE FAMILY NAME. At this stage, would it be my maiden name or his last name and then the marriage certificate would prove we are married?

As the AOS is meant to be filled out after you get married (but alot of us have it filled out and ready to go before the wedding!), your FAMILY name will be whichever name you decide to keep or take: original birth surname or hubby's surname. :)

Hey! I think the other posters have essentially answered the question, but I wanted to interject that getting married does not legally change your name. You must have your name changed through a government entity (court or some other government agency). So, you would probably have to start by either changing your social security card or your driver's license.

Also, I think it has been advised that you send a certified copy of your marriage license with your AOS application. Some people have gotten RFEs for sending in the photocopy. It's only $4 for a certified copy at the Davidson County Clerk's Office in Nashville and they are pretty quick, too.

Another question with the marriage certificate, i was going to submit the AOS, 1-131 and 1-765, and i know they need copies for the marriage certificate, i want to know do i submit 3 certified copies or 1 certified copy will be okay for all 3 applications.

Hmmmm.... That is such a good question. I am/was only going to submit one certified copy and attach it to the 485. I think/thought AP and EAD are available because the applicant is an AOS applicant and since the eligibility stemmed from AOS I was not going to submit anymore copies. But, now that you asked that, I need to read through the instructions again to make sure. I thought only AOS required a marriage license evidence if it is based on marriage. :unsure:
