CFO required after already immigrating to US? (split topic)

Hi all,

My wife was approved for K-1 on 5-Feb-2015, and we married in US on 16 May 2015, AOS filed, EAD and AP combo card received and we are ready to bring her 17yo son on K-2.

  • Case has been transferred to and acknowledged by Manila Embassy
  • DS-160 Submitted
  • Visa Fee paid
  • Son Passport issued
  • NBI obtained
  • I-134 completed.
  • NSO Birth Certificate

My wife will travel to Manila to walk him through the Medical, Interview and CFO process and then fly back with him.

I am sending with my wife:

  • Certified Marriage Certificate (2 originals, plus copies)
  • Notice of Action (originals and copies)
  • I-134

We have 2 questions:

  1. We have not been able to filed the marriage with NSO or change my wife's passport, that's the reason for the certified marriage certificates, is this ok?
  2. She was previously married to the father of her son, do we need a letter of consent from ih?

Is it required for your wife to take CFO seminar? She already been to USA .... I am a bit confused.. Because me and my fiancee applied our K1 visa here in UAE...and planning to fly to USA without CFO sticker... my question is, do I need to take CFO seminar if ever I will go back to the Philippines in the near future...

We're not sure. Some are telling us it is only required if it will be the first time. She will land in Manila in about 11/2 hours and she is going to check. We flew to the US from Dubai so there was no CFO requirement. I'll try to update this topic when we know.

If you go back to the Philippines AFTER you have your green card... NO you do not need CFO. CFO is for exiting IMMIGRANT only.

If you go back to the Philippines AFTER you have your green card... NO you do not need CFO. CFO is for exiting IMMIGRANT only.

CFO is a Philippines requirement ONLY. If you are not exiting the Philippines with an immigrant (or K-1) visa you do not need to complete CFO.

She only has the combo EAD and AP card but will still hold she does not need CFO?

The combo card is not well known, not even with CBP agents at POE in the states ( :lol: ). ( AP does not grant legal resident status) Also note that at that time your wife IS NOT an LPR as the green card has NOT been issued, so it is possible for Philippines immigration agents to look for the CFO sticker.
