Hi to all VJ members,
I'm the spouse of an US Citizen , we already chosen to fill a K3 visa, because it's faster . We began the process on February , we sent an I-130F and have received a NOF1 and sent back a 129F to get a K3 Visa.
On 17th of July we got an approval from USCIS, and our case was transferred to the National Visa Center. About one month later, we have received an email from the NVC for following the instructions to complete our application ! Unfortunately for us our I-130F and I-129F was approved at the same time , So NVC got a priority to the I-130F. My spouse called them, and the officer told him that our K3 visa has been removed , and now we have to follow the I-130 F/ CR1 Visa, how can that happen?
Is there Any same experiences right here , please share with us ! we are completely confused

hi

the K3 process is almost obsolete, there are very few that are approved and go through the K3 process instead of the normal consular processing

so you will go through all the process at the NVC stage and have the interview at the US Consulate in your country

since you sent both, the i139f was closed and you will go through consular processing

the i129f has to be approved before the i130 to maybe even get a chance at the K3 processing

This has been the normal practice for years, when the I129F and the I130 are approved together, the I129F is closed at NVC

good luck, I'm sorry you were unaware of this procedure

Sorry, but I don't get this.

You have a played both the Pettition, I-130 and I-129F?

Is it allowed? I mean, can you make 2 applications, at the same time, for the same goal?

They are both spousal visas; the K3 was useful way back, when the CR-1 too several years to get approved; the K3 would allow the spouse to come to the USA and then adjust status, like a K1, that way the couple at least couple be together, even if the foreigner could not work. Now, the K3 is obsolete as mentioned above, and usually removed at NVC stage.

Thanks all for your answers ,

In oder hand , since we didn't have any other choice , we were obliged to follow with the CR1/IR1 visa , and completed our case. On the fifth of October, we have sent all the required documents, and paid all the fees ! and till now we didn't receive any information from the NVC .
Please can someone informs us how much time it takes to the NVC to schedule for an interview !
Thank you in advance!
