My husband entered on a K-3 in January. He'd had his medical in Toronto last October. We applied for AOS but did not include the I-693, only a photocopy of the "Vaccination Document Medical Worksheet Two."

The RFE asks for the complete I-693, as though he'd never had a medical at all. Can I phone the civil surgeon in Toronto and ask him to fill out the whole form again? Or should I ask a civil surgeon in the States to transcribe only the I-693a (supplement?)

Thanks.

Get an Infopass appointment and ask them -- they can steer you the right way.

We had a similar issue, and what the officer told us to do was have the I-693A transcribed, and then write a note to tell them that my husband had completed his medical within the last year as part of his K-1 process, and to look for it in his K-1 file.

If you don't send them exactly what they ask for, there's a risk of having your case denied outright. There's a lot at stake, so I definitely recommend you talk to an officer with USCIS at an Infopass appointment.

I hate this process! It is crazy that they gave you a RFE. I submitted the same form that you submitted and I didn't receive a RFE. I guess it depends on the officer. You will have to take the vaccination supplement to a civil surgeon in the US. We tried to have a canadian civil surgeon fill out the I-693a and crazy enough the doctor claims he never heard of this form. I guess the form is only available in the US. The civil surgeon abroad fills out the vaccination supplement.

I betcha they "lost" it. That's what they told us anyway when I got the same RFE. We got the Senator's office on it.

See my PM response, I hope its helpful!

Thanks, Reba, here's my plan, based on the path of least resistance:

1. Call Dr. Seiden in Toronto.

2. Ask him to send us a filled out I-693 and supplement, since that's what the RFE asks for.

3. Include a sharply worded letter with the RFE stating that K people only need the supplement.

If this works, we might advise others to get this paperwork done at the medical, since they'll need it for AOS. Good plan?

I don't think the doctor in Toronto will have an I-693. Their form would be a DS form, because that medical exam is requested by the Department of State. The I-693 must be filled out by American civil surgeons -- it's just not needed by K-visa holders who have had a medical in the last year.

The path of least resistance here is probably having the full medical done again. I still recommend you make an Infopass appointment first.

yeah, the panel physicians won't have the I-693.

All I did was get an exact duplicate of medical from him, and then sent that with a letter in response to the RFE, reminding them that K3 already has medical before entering the country and should not need another, according to their own law.

That was after our senator's office assured us that they'd determined that USCIS had "misplaced" my file, and had, with their prodding, relocated it.
