Is I-601 processing faster with K-3???

Hello everyone!

My husbands's CR-1 visa was denied last year in Brazil and sent back for revocation. Our lawyer suggested us to start with the new I-130 and so we did. Later we filed I-129f too. Both were approved and now we are at NVC stage. It is been a long process for us overall (over 3 years total), we are going trough a lot. But shortly... we are thinking whether to go with VR-1 visa or K-3. Because we know that at the interview his visa will be denied and we will need to file I-601 and, who knows, how long will we wait for approval. Our lawyer says that, since we filed I-601A before and it was approved, it shouldnt take long for the new approval. He also suggested to go with K-3 because waiver (I-601) could be approved at the spot ! Is it true? anyone knows?

Another thing. Our "old"case that was sent for revocation was reaffirmed on september, 22 and sent to DOS. We were so happy. But recently they returned this case back to USCIS??? even our lawyer is confused! Why would it be? how long will they review? or should we just forget about that case and concentrate on a new one?
