Hi!

How to make deportation?

You should speak with an immigration attorney, if you are the least bit confused as to what your responsibility is to this alien. If you do not believe that he married you in good faith there are two options. Divorce him, and let the chips fall where they may, or, if you are concerned that he will secure residency despite the termination of the marriage, AND he is not entitled to that, then you could make your concerns known to USCIS. Being entitled to residency is not a matter of whether or not he is or was a good husband, but rather a question of whether he entered into the marriage fraudulently, and used you for his own immigration means.

If you were to refuse to file a joint I-751 with him, while you remain married but absent overseas, there's a chance that if he is savvy to the regulations, he could use that to his advantage and claim that you were exerting control over him by your refusal to participate in the immigration process. Of course there is little consequence to you, if he did do that, except that he could preserve his residency under the battered spouse provisions. That is why, if there is a bona fide reason that you believe you should not endorse his petition, it is wise to let the Service know. It can be accomplished by certified mail to the Service Center and the local district office in your area (both). To be compelling, you'd have to present some significant proof that your husband deceived you into marriage for immigration benefit alone.

Since the deadline to file the I-751 has already passed, and your husband was already in removal procedings prior to your marriage, chances are an untimely filing of a joint I-751 would be flagged for follow up at the minimum or even outright denied. That is, UNLESS you give your errant husband a perfect excuse by preventing him from filing alone or simply abandoning the marriage.

I had a paper husband once. I got him out of Teen Beat magazine.

:ot:

Anyone remember ' Tiger Beat ' and ' 16 ' ? I think there was one called ' Flip' , also ?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Whenever I think of someone trying to deport their spouse because it didnt work out, it smells an aweful lot like revenge. not that some don't deserve it, but some don't.

I thought a paper husband implied that they both knowingly engaged in immigration fraud, ie. greencard marriage. In which case, the OP has put herself in quite the dilemma. I can't imagine that USCIS would be too happy about an admission of a paper marriage.

Sorry to say that it sounds like the OP has made her bed....

You would be suprised to know I still have a few of those 16 Mags ! The date on them is 1968. That was before zip codes, if I recall.
