Timeline

I'm going to have a co-sponsor fill this form out with me because I'm still in school (my last semester).

I have a job in place for well over the poverty limit, should I include that and my offer letter from the firm? (The letter states how much I'll be making in a year, and when I start my job, I've already accepted the position after graduation)

I currently only work like 8 hours a week (internship) I'm taking a full load at my university so I'm only making pocket money. Will that look really bad?

My co-sponsor has to fill out his own form right?

Do we send these forms to my fiance so that he can have them when he brings them to the interview? Or are we sending these forms to NVC or the Embassy?

I've read on a list of guides here that my fiance should take this form with him to the interview, so I've been reading it as we have to send him the I-134 along with supporting document? Otherwise how will he have a copy for the interview?

02 - 09 - 2007 - Sending off of my I-129F package

02 - 13 - 2007 - NOA1 Received

02 - 21 - 2007 - Touched!

03 - 01 - 2007 - NOA2 Received

03 - 02 - 2007 - Touched Again!

03 - 06 - 2007 - NVC Received

03 - 07 - 2007 - Was told by email I-129F will be forwarded to Sydney

03 - 08 - 2007 - I-129F picked up by DHL and on it's way to Sydney!!

03 - 12 - 2007 - Sydney Consulate received packet! From DHL: 1:48 pm Shipment delivered WOOT

03 - 19 - 2007 - Packet Three is sent off!

03 - 20 - 2007 - Corey goes to get his fingerprints/police check completed. Now we wait for the investigation and then I can be assured he's not a criminal =]

03 - 21 - 2007 - Corey gets Pkt 3 via Registered Mail

03 - 22 - 2007 - Sent Corey a copy of all the documents and the notarized I-134.. hopefully everything arrives safely!

04 - 17 - 2007 - Corey's Medical Examination.. Let's hope everything goes great!

05 - 01 - 2007 - Corey's Medical Rescheduled to this date because doctor was away!

05 - 04 - 2007 - Corey's Initial Interview date! (We only had ONE week's notice!)

05 - 30 - 2007 - Corey's Rescheduled Interview date because there was no time for the initial one

I suppose you would be graduating and starting work in May or June? Might be close enough to be considered ok. But just in case, I would recommend having a co-sponsor lined up. Its better than getting the visa denied over this.

Nah, They worked it out for me so that I could go back to Australia to visit one last time. So they're going to let me start work end of August. :D

They're going to let me have the summer off before I start my job. Which is greaaaat!

One last 3 month summer vacation! I won't be expecting those anymore since i will be working like other people.

But do me and my dad send our I-134 forms to the consulate? My fiance? or the NVC?

There is no Joint ( co ) Sponsor provision with the I-134, ONLY a Sponsor. If the USC fiance or spouse does not meet the requirements then one needs to find another sponsor, preferably a close family member or friend.

The I-134 is submitted to the Consulate at the interview along with any evidence to show that the applicant will not become a public charge.

Ohh, I see. I was reading sponsor as in the person petitioning the beneficiary to come over. So only my dad has to fill out the I-134 form and send it over to the appropriate office? I don't need to fill one out? Cause posts earlier in this thread stuff about co-sponsor as well so I'm a bit confused.

To help you understand the I-134 and its use in overcoming the public charge.

9 FAM 40.41 N4.6-3 Use of Form I-134, Affidavit of Support Under INA 213A

a. With the required use of Form I-864, Affidavit of Support Under Section

213A of the Act, under INA 212(a)(4)© and INA 213A for so many

classes of immigrants, the use of Form I-134, Affidavit of Support, has

been reduced considerably. Nevertheless, there still are circumstances

when Form I-134 will be beneficial. This affidavit, submitted by the

applicant at your request, is not legally binding on the sponsor and should

not be accorded the same weight as Form I-864. Form I-134 should be

given consideration as one form of evidence, however, in conjunction with

the other forms of evidence mentioned below.

b. If any of the following applicants need an Affidavit of Support to meet the

public charge requirement, they must use Form I-134, as they are not

authorized to use Form I-864:

(1) The self-petitioning spouse of a deceased U.S. citizen, and any

children there from (see INA 204(a)(1)(A)(ii));

(2) The self-petitioning spouse of a U.S. citizen, and any children there

from, who has been battered by or subjected to extreme cruelty

perpetrated by the spouse (see INA 204(a)(1)(A)(iii) and (iv));

(3) Returning resident aliens;

(4) Diversity visa applicants; and

(5) Fiancé(e)s.

c. The simple submission of Form I-134, Affidavit of Support, however, is

not sufficient to establish that the beneficiary is not likely to become a

public charge. Although the income requirements of Form I-864, Affidavit

of Support Under Section 213A of the Act, do not apply in such cases

(i.e., the 125 percent minimum income, the need for three years income

tax returns), you must make a thorough evaluation of other factors, such

as:

(1) The sponsor's motives in submitting the affidavit;

(2) The sponsor's relationship to the applicant, (e.g., relative by blood

or marriage, former employer or employee, schoolmates, or

business associates);

(3) The length of time the sponsor and applicant have known each

other;

(4) The sponsor's financial resources; and

(5) Other responsibilities of the sponsor.

NOTE: When there are compelling or forceful ties between the applicant

and the sponsor, such as a close family relationship or friendship of long

standing, you may favorably consider the affidavit. On the other hand, an

affidavit submitted by a casual friend or distant relative who has little or no

personal knowledge of the applicant has more limited value. If the sponsor

is not a U.S. citizen or lawful permanent resident (LPR), the likelihood of the

sponsor's support of an immigrant visa applicant until the applicant can

become self-supporting is a particularly important consideration.

d. The degree of corroborative detail necessary to support the affidavit will

vary depending upon the circumstances. For example, for a relatively

short-term visitor, little, if any, would be required. In immigrant cases,

however, the sponsor's statement should include:

(1) Information regarding income and resources;

(2) Financial obligations for the support of immediate family members

and other dependents;

(3) Other obligations and expenses; and

(4) Plans and arrangements made for the applicant's support in the

absence of a legal obligation toward the applicant.

e. To substantiate the information regarding income and resources, the

sponsor should attach to the affidavit:

(1) A statement from an employer showing the sponsor's salary and

the length and permanency of employment;

(2) A copy of the most recent Federal income tax return as of the date

Form I-864 was signed;

(3) A statement from an officer of a bank regarding any accounts,

showing the date the account was opened and the present balance;

or

(4) Other evidence adequate to establish the sponsor's financial ability

to carry out the commitment toward the immigrant for what might

be an indefinite period of time.

f. If the sponsor has a well-established business and submits a rating from

a recognized business rating organization, you do not need to insist on a

copy of the sponsor's latest income tax return or other evidence.
