Hi all,

I had my interview at the consulate in Montreal on Tuesday and I got denied due to not have an original birth cert. Everything is approved and no other problems. The one I had I thought was the the original but I thought wrong. I feel ive really let down my wife and her family but thats another story.

Anyways I'm stuck back in Canada now waiting for an original birth certificate to arrive form Ireland and then all I have to do is send my Passport along with the original birth certificate and wait for them to send my visa to the courier for me to pick up.

My question I have for the forum is has anybody gone thru this before? The consulate said 6-8 weeks when they get my passport and birth certificate.

Quick timeline:

- We got married on September 2nd 2014

- We filled the I-130 on September 20th 2014

- I-130 was approved in March 2015

- Interview date October 20th 2015

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

you write you are denied

Did you actually get denied or as you late state, they wait for original birth certificate?

Is your case sent back to USCIS or are you in AP at embassy waiting on this document?

This is important for this community to know so they can advise

The consulate officer said everything else is ok. They just need an original birth certificate. I got an refusal letter at the consulate saying "further consideration will be giving to your visa application after you obtain and present the documents listed above and/or the following:" i.e. original birth certificate.

So I am just wondering if people ever needed additional information required after the interview stage at the consulate and how long it took them to get their visa. I was told 6-8 weeks

Temporary Refusal

It is very common for beneficiaries of an immigrant visa petition to have their case temporarily refused under Section 221(g) of the U.S. Immigration and Nationality Act. This usually happens if we need more information in order to make a decision, documents are missing or incorrectly filled out, or further administrative processing is required. If your case is subject to 221(g), you will be given a detailed list of the items that you need to provide. How long it takes to process your case to conclusion will depend on the time it takes you to gather and submit the information and documents needed. Once you have them, call the number on the 221(g) refusal to schedule an appointment.
You have one year from the date you were refused a visa to submit the additional information. Otherwise, if you do not provide the required additional information within one year, you must reapply for the visa and pay another application fee.

Getting your hands on your birth certificate from Ireland shouldn't take long at all. If you order online from the registrar you'll get a certified copy in the post within a week (if delivered to an Irish address) and it only costs 20. It's the long form one you'll get.

More experienced VJ'ers, please correct me if I am wrong, but where a certified copy of the birth certificate is issued by the appropriate authority (registrar for Ireland) I believe this is a good as the original for US immigration purposes.

The officer at the consulate said I don't have to come back to Montreal at all, just post my passport and birth certificate to them and then wait for my visa to be sent to the courier. I have applied for my birth cert back in Ireland which they said should be here in Ontario in about 5-8 working days.

Yeah I have applied for my birth cert, but its going to take at least 5-8 working days for it to come! But in fairness I just used An Post which I shouldn't have. I should of used FedEx to overnight it or something to me here in Ontario
