My mom and stepdad are married and have one child together. Me and my other sisters are children from my dad and mom (from a previous marriage). My stepdad has got and L1 visa. Can we: the children from the previous marriage also get an L2 visa since my half-sister and mom can get them.We've visited the ambassy today but they said they will respond within 7 days to the request. I'm very nervous because if we don't get a visa my mom, half-sister and stepdad need to go and the family will be drawn apart

I just had a quick look at the USCIS website, it says L2 visas are available to "family members", without specifying precisely what this entails.

A quick google for "L2 visa stepchildren" comes up with several different answers. Most seem to be positive, as I'd expect, but one, which I don't believe, seemed to think that your stepfather would have to formally adopt you for the visa to apply to you. I doubt this is the case, but I don't have any personal experience.

I think your stepdad needs to talk to the company lawyer.

That said, there may be another hurdle to overcome. Your haven't mentioned the current status of your birth father. Your parents (mother and stepfather) may need permission from him to take you and your sisters out of the country and come to the US. This is subject to the laws of your current country of residence.

I don't now anything about the company lawyer. They directly mentioned to my stepdad that he would get a visa, my mom would also get a visa but they didn't sign her document directly but would send the visas via the post. For us they would call the ambassy from my home country (my stepdad isn't from my home country so we applied in his country of birthfor the visa) and would send us the passports too: with or without the visa. At the interview they asked like three times why my stepsad, my mom and me (and my sisters) have a different last name. In my country your last name doesn't change when you marry. And we, we still have my dads last name. They simply didn't understand this. They also asked about why we weren't adopted by my stepdad. This can also not be done according to the law in my country of birth because my dad is still alive.

My dad is a bussines man so he can not take care of us, because he's only home like once in the two weeks. He is willng to sign this paper what tells that he is OK with us moving to the U.S.A. We didn't have this paper with us when we went to the ambassy.

I do not see a problem, melded families are quite common.

I would imagine the delay is due to you being add ons, if you had all applied at the same time you would all have been processed at the same time.

L2 is good to age 21.
