So finally we are almost done with our AOS package. Only one thing, my husband have tax returns from 2013 and 2014, he did file 2012 but can't find that paper. Are we ok to just send these other two years that we have?

Question 18.a asks if we have filed for the three most recent years we check yes.

Then 18.b which is an optional thing do do asks if we will attach all three copy's of these tax returns (we can only give two) assume we don't click this box.

Question 19 wants us to fill in the total income for the three last years, what do we do here?

Anyone ever got an rfe for doing this?

My husband is well above poverty line if that matters.

Please help!

Yes, to the first 2 questions.

Question 19, you'll need to put the total income (Line 22) from Form 1040. Since your husband doesn't have his 2012 taxes, he can request an IRS tax transcript (it's free) and he'll be able to obtain the number from there. It usually takes about a week to receive them.

Also, you have the option of sending only IRS tax transcripts but, if you send the actual tax returns, you have to make sure to provide W2s as well.

The I-864 only requires that you sent the most recent IRS tax transcript or tax returns & W2s. Either way, he'll need to find out how much he made in 2012 so he can put the number down on the form.

Like the form says, it's optional to send all 3 years.


So if we send - 2014 W2, pay stubs from 2014 and employment letter?

Yes, you can send 2014 federal tax returns, 2014 W2s, recent pay stubs and employment letter. These are enough. You don't need to send the past years tax returns.

You should however still order the 2012 tax transcript so you can find the total income and list it on the form.

Do they really look up these numbers? He thinks he know how much it was, think it is "dangerous" for us to put down a "guess" number?

Is it worth possibly getting an RFE and the accompanying delay for something that you can easily do?

Also submit proof of the current and continuing income, not just tax returns unless the sponsor is self employed.
