AOS interview need help

okay so some of you know i had my green card interview with my husband on Sep 28th and he said we would be approved if he had all the correct paper work if not he would send me a letter saying what i was missing and needed to sent. but either way he believed our story and in his eyes were approved i literally asked him 90 times so im approved right even if i don have all the paper work i just need to give it and im approved also and he kept saying yes also he said my I-130 is approved straight away but no site updates and no letters off them since the interview i haven't heard ANYTHING. im starting to get worried anyone been through this or got advice ?

Our green card interview was in April of this year. We were also told if all the paperwork was there we were approved. If not they would mail something to us. We didn't hear anything, By July I started calling and calling. We got the green card in August, finally, 4 months later!

Breathe. I completely understand the impatience (I was exactly the same), but bureaucracy moves at the speed it moves. The IO told you that the I-130 would be approved and that the I-485 would be approved if all the paperwork was complete. Right?

You said on the March Filers thread that you called the service center and they told you they'd sent an I-797. My guess would be that it is the approval notice for the I-130. The I-130 has to be approved in order for the I-485 to be approved (because if you don't have an approved I-130 petition you have no basis on which to adjust status) so the I-130 approval always happens first. It could be a request for more evidence, because the notice for an RFE is an I-797E, but from what you've said about your interview and what the IO told you, I think it's more likely to be the I-130 approval notice. Since you haven't received anything, maybe you could call them again, explain that you were told 2 weeks ago that an I-797 had been sent but that you haven't received a notice, and ask them to confirm what was sent, when it was sent and where it was sent to. See if they'll tell you whether it was an I-797 or an I-797E, and what it was for.

As for the I-485, after we received our I-130 approval notice our attorney told us that the I-485 approval could happen in anything from a few days to a few months. We'd been told at the interview that we were "recommended for approval" and neither we nor our attorney were expecting any problems, but sometimes files just take longer to make their way through the system.

Eighteen years in the US and I still don't understand Velveeta, TV ads for prescription drugs, only getting 2 weeks paid vacation, or why anyone believes anything they see on Fox "News".

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
