Hi im a bit confused on which form i should fill out for the AOS is it the I-864 or the I-134.

My wife is the USC and has been in the UK for the last 14 years were we got married. She has now moved back to the US to be with family. My issue is with what form to fill out and if its the I-864 it says it has to be with financial proof ie tax return etc, however she left her job in th UK some time ago to move back to the US so she has no money and is being supported by her family and a rather large inheritance they just recieved so we have no financial documents.

I-864 is for AOS.

You can qualify on assets if she has 3 times the amount needed . It there are 2 of you that's 19912 X 3=. Or you need a joint sponsor. Did she still file her US tax returns last 3 years? That is also required.

Review the above along with the instructions for the I-864 to learn what's needed. If she can't meet the financial requirements then a joint sponsor will be needed.

My husband and I are also using assets for our AOS. The minimum is three times the federal guidelines, so you need at least $59,736. But they usually want a bit more over the minimum when using assets. If your wife got a large inheritance, she can submit documents showing that along with a bank statement, that should prove that you have the necessary assets. If you have assets in the UK, either in her, your or both your names, you can usually count these too.

Just FYI, even if your wife hadn't had to go back to the US, you couldn't have used her UK salary unless it would have continued from the same source once you moved to the US.
