Upgrading Petition from Permanent Resident to USC

Hi guys,

Few questions:

1) What is the wait time for filing - USC unmarried child over 21?

2) If Permanent Resident started petition for Unmarried Child over 21 and is now Citizen, how long will it take to file if they upgrade the petition with the USC status?

3) Do they subtract time already spent in the previous permanent resident category? For example, if they have already waited a year in Permanent Resident status, once they inform USCIS of new status, will USCIS push the petition for USC child up by a year or will it reset the clock as if it is an initial filing for USC Unmarried child over 21?

The current PD for the F1 category (USC filing for unmarried over 21 children) is 15 JAN 2008.

For the F2B category (LPR filing for unmarried over 21 children) is 15 JAN 2009.

So, if you don't upgrade your petition, you'll actually save 1 year.

However, with the new October 2015 visa bulletin, you're able to begin processing if your PD is before 01 JUL 2010 for the F2B category and 01 MAY 2009 for the F1 category.

Even though you're a USC, it'll probably be best to complete an opt-out from upgrading the petition so your child will have a visa available one year sooner.
