Desperately seeking some guidance

Hi peeps my father in law who is a us citizen is filing for his married son. The petition started in 2006. My brother in law wife and his child should join him when he is migrating to the us however it seemed as it was only one I 130 was filed because on the noa2 it is only my brother in law name on it. Can this be rectified at this time? If so how can it be done. The petition is at nvc now waiting to get a case number and invoice number. His priority date is may 22 2006. Please advice.

The NOA will have only I beneficiary(brother in law) name one it. There should be NOA for each person. Are there any documents with the other persons name, u need to check,if not that your brother inlaw might be the only one migrating.

They only sent in his wife and child birth certificate and marriage certificate.

If I am not mistaking....your father in law had to submit an I130 for each person. If not then your brother in law would have to come and petition for them.

Your brother-in-law is in the F3 category which allows dependents to immigrate as well. Your brother-in-law's wife and child will be able to immigrate with him as long as they were listed as family members on the I-130 form.

Thank you. I got the case number and invoice number. However when I went on the site to pay aos fee I only see my brother in law name and his wife's name as IV applicants. At the time of filing their daughter was not born yet. Their daughter is now 8 years old. How can I add her to the filing now? Even though her name is not listed as an IV applicant can I still put her on the AOS form?
