Do you incur time away when you are a Conditional Green card holder??

Green card holder here less than a year. Left the US. When do they start incurring time away against their Removal of Status? Or do they?

I mean can they stay away 3 months, 6 months a year or no matter? I know time away counts against for Citizenship but have not a clue about Conditional green card holders. They can removed conditions in 2017 other wise.

My husband was told by the Costa Rican consulate not to start out of the country for more than 3 months. Maybe that is what they tell everyone when they hand out visas. We won't be talking any chances

Under 6 months is relatively safe, over may or may not cause 'discretion' issues upon re rentry.

Over 6 months also re starts the clock for naturalization.

The only difference between a conditional GC holder and a 10 year GC holder is that the LPR status expires when the GC expires for a conditional GC holder. The GC holder--conditional or otherwise--must follow the rules for maintaining their LPR status. Any single trip under 6 months generally goes unnoticed. Trip between 6 months and 1 year might get some scrutiny by the CBP agent. Trips greater than 1 year require a re-entry permit to be filed for before the LPR leaves the US. Trips greater than 2 years causes the LPR to loose their LPR status and is not allowed back into the US unless they can show unusual circumstances that caused them to remain outside the US for an extended period of time. The continuous residency for USC is reset for trips greater than 6 months.

So as long as they can keep their LPR status, they can file for ROC when the time comes.

I have a friend who's husband left after 7-8 months entry. Was abroad 3 months and came back. Was scrutinized heavily the only thing that saved him was his US driver's licence. So I guess it just depends on the officer at certain POE's.

Can someone clarify this? After you send in your I-751 to remove conditions, you receive a NOA letter extending your GC for one year.

Does this mean you can now leave and remain outside the US for one year instead of just six months?

Would remaining outside of the US for more than six months still reset the Citizenship clock,or is there an exception for those who sent in an I-751 and are awaiting the permanent GC?

Yes, it also would reset the clock and it's still 6 months out of the US.

All the extension letter does is extend the validity of your 2 year GC for 1 year beyond its expiration date while you wait for the 10 year GC. As a LPR you must comply with all responsibilities to maintain your LPR status. Being eligible for citizenship is a whole different subject, but any trip greater than 6 months has an effect on your continuous residency requirement.
