Hey guys, just a question,

our 751 still pending (filed December 2014, had interview March 2015, still waiting for decision)

My extension letter expires in February 2016, still happy married, over 3 years and can apply for citizenship in December (90 days prior 3rd anniversary).

My question is - can i apply for citizenship or I have to wait for ROC decision to be made?

Timeline

Yep, you can apply for citizenship before a decision is made. Essentially, they'll either adjudicate the ROC petition before or at the same time as your citizenship petition.

2. Spouses with Pending ​P​etitions and Naturalization Applications​

An application for naturalization may not be approved if there is a pending petition for removal of conditions.​If an applicant’s petition to remove conditions is pending at the time of filing or is ​filed prior to the interview, USCIS will adjudicate the petition to remove conditions prior to or concurrently with the adjudication of the naturalization application.​

08/04/2016: Received DS-261/AOS Bill

08/06/2016: Completed DS-261/Paid AOS Bill

08/16/2016: Received IV Bill

10/11/2016: Submitted AOS/IV documentation

10/11/2016: Paid IV fee bill

10/14/2016: Submitted DS-260

Yep, you can apply for citizenship before a decision is made. Essentially, they'll either adjudicate the ROC petition before or at the same time as your citizenship petition.

So in this case, will they call only me for an interview and test or my wife has to go through everything again?

You already had the ROC interview, so all you're awaiting is a decision. Applying for citizenship will just "force" them to make a decision on your ROC petition.

Your wife won't be needed at the citizenship test/interview.

You already had the ROC interview, so all you're awaiting is a decision. Applying for citizenship will just "force" them to make a decision on your ROC petition.

Your wife won't be needed at the citizenship test/interview.
