Embassy wants joint sponsor but have WELL over income requirements

According to my fiance, they didn't even look at my Affadavit of Support or the supporting documents.

While your situations seem similar, Amena had to file the I-864, while fiance's provide I-134. (I think I have the numbers correct.) The I-864 is legally binding, while the I-134 is not; therefore, the Consular needs to make sure the financial support is more evident and may not even require it for a fiance petition. I still think they meet the support requirement, though. After fiance's AOS, then we need to prove the same type of financial support. I feel like Amena's affidavit would have been accepted during an AOS with USCIS. I think the finace's have an easier time, because technically, they can apply for an EAD before AOS - although it's impractical because of the processing times.

A K visa applicant and any accompanying children must meet the public charge requirement of INA 212(a)(4) (8 U.S.C. 1182) like any other visa applicant.
Evidence of support is usually requested by the consular officer. There is, however, no absolute requirement that an affidavit of support or other public charge documentation be presented. It is only necessary that the consular officer be able to conclude that the alien is not likely to become a public charge. It would not be unusual, therefore, for a healthy alien of working age, applying alone, to be able to establish eligibility during the visa interview without the need for substantiating documentation.

That is odd. We have similar employment history. I worked there as a contractor as well and haven't worked since October 2014. Like you I have other assets which will get me through this employment hiatus. Unlike you, I don't have any recent employment.

Because of this I killed them with paperwork. Neither of my banks could provide a summary of my year-to-date deposits (which were few, the only ones were from some inheritance after my parents' passing last year), so I just provided all the monthly statements. My mortgage is low so I provided that statement (small liability and high-value asset, plus it's a rental). Additionally, I wrote a personal letter stating, in short, that I am currently unemployed but I saved a lot, have some valuable assets, own some liquid assets like stocks, and have plenty of cash on hand to get me through another year or so. According to my fiance, they didn't even look at my Affadavit of Support or the supporting documents.

I agree…it is odd. I loaded them with paperwork too. Seriously, between investments and my bank account it was well over $200k. I think it's just who you get at the time. So my joint-sponsor documents are on their way to him now. I resubmitted my I-864 too with all my recent stubs just in case there is something wrong with the joint-sponsor. Keeping my fingers crossed!

09/11/15: Letter from NVC. Package sent to Embassy. Interview date received!

10/20/15: Interview. Went to Admin Processing. Asking for joint sponsor.

11/09/15: Joint Sponsor docs submitted to Embassy

11/11/15 : ceac.state.gov says "ISSUED!!"

11/15/15: VISA IN HAND!!!!

11/21/15: ARRIVED! :goofy:(L):dance:

 

09/14/2017:  File I-751 Petition to Remove Conditions on Residence (extended 18 months)
01/24/2019: RFE received
03/18/2019: Mailed RFE
04/09/2019:  Approved
12/15/2019: N-400 Application for Naturalization filed
01/06/2020: Biometrics
09/22/2020: Interview (NOT APPROVED AT THIS TIME)
