K-2 SS#'s

Am I right in saying that K-2's cannot get their ss#s until they get their greencard? We filed for AOS with DORA January 5 and had heard this? Anyone out there know?

That is correct. My K-2 child is 7 years old, and has to wait until GC before I can apply for a SSN for her. For tax purposes we applied for a ITIN # for her. (IRS form W-7)

If you just must get your child an SSN you can always spring for the EAD card, which to me would be a waste of money, since the ITIN works for filing taxes.

Just remember to contact IRS after the child is assigned an SSN if he or she gets the ITIN first.

My son is a K-2 entrant and has still not got his GC - in fact they just denied him last week! He was issued his first EAD back in 2003 and we went straight to the SS Office and they issued him a card.

Oh, and my 13 year old daughter was issued her SSN when she got her EAD too. She needed it to register her for school in VA and there was no problem getting it issued - even though at that time she didn't have a GC either.

If the child is not of legal age to work, what's the point of applying for and wasting money on an EAD?

My daughter's school wanted a SSN also to enroll her, but they gave her a student number instead, and took photocopies of her passport/visa.

SSA told me when I applied for my SSN, that once my child gets her GC, bring it in, and they will remove the notation on my SSN, and issue my child a SSN...it's no big deal!

For tax purpose's that's why there is ITIN numbers (people who are not eligible to obtain a SSN)

The OP did not state how old her child was. My daughter was not of legal age to work in the US when she was issued her EAD, but was within the year, but it aided us in getting her SSN quickly.

I don't know what the situation is with children younger than mine.

Thanks guys. After talking to my CPA she confirmed that ITIN number is all we needed. So we just send it in for both the kids with our tax return and it's sorted.

Yeh, I sent in for EAD for my son, but he is 17 now. He wants to get a job. So when he gets the EAD, he can get his SSN.
