My case was approved in 2 months by USCIS, was hoping for a fast processing by the NVC as well, but so far, no go...

I submitted my case while I was a Permanent Resident, was naturalized 09/04/2015.

The case to bring my wife from Thailand was approved by USCIS on 08/31/2015, so I called the NVC to update my status after naturalization. The rep advised me to upload my certificate through the website; Easily done.

I did not hear anything from them, so I called back on 10/06, the rep was able to provide me the case number and invoice number, and advised me to email my naturalization certificate since it was not updated yet. Easily done.

Today I called the NVC, and I am being told that they are not updating my file until the priority date becomes current (which takes years as a F2A petition!). Was advised they couldn't do anything and I would not be able to speak to a supervisor to get it updated.

Contacted the senator's office in KS to get them involved, to get at least the case status updated to CR1 so processing may start soon.

Couple of questions:

1) Case number when doing a search displays that it is "At NVC", will it continue to read this status?

2) If I try to pay an invoice (I have the case and invoice #, so I thought it might work), I get a message that the case is in process of termination (phone reps assure me it is not). Anyone see this before?

3) Since I am stuck, is there anything we can do to start preparing? We already have the documents below.

- Passport for petitioner and beneficiary

- Police Certificate (in English)

- Marriage certificate (translated and certified)

- Name change certificate (translated and certified)

- Birth certificate (translated and certified)

- House Registration (translated and certified)

For the AOS:

- W2's for last 4 years

- Tax transcripts for last 4 years

- Employment Verification

Sorry, didn't remember things to be such a hassle when I moved here myself, just needing some assurance and direction.

1) Yes, once a file is approved, it's automatically moved to NVC and it will say "At NVC" until the file is sent to the embassy for the interview.

2) From this link: http://www.visajourney.com/wiki/index.php/NVC_Process

  • Note: if you're getting an error message ("Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time…" or "This case is in the process of termination. Fee payments and online forms can no longer be accepted…" or "You cannot make online payments for your case at this time. Please contact the NVC if you have questions or need further information."), do NOT panic. This is actually good news! If you just got your case number, then this message means NVC is inputting your case in their system. If you get this message a few days after case number generation, then it's a good possibility that NVC is invoicing your AOS bill. And if this message appears a few days after DS-261 acceptance, then there's a good chance the IV bill is being invoiced.'

3) Petitioner's passport is not required. House registration not required. Have you obtained a police certificate yet? For most countries, it takes a while to get this. You'll also need passport sized photos. It's also good to include an employment letter and recent pay stubs and maybe you can start completing the I-864 forms.

Make sure to submit only photocopies to NVC. The originals should be taken to the interview. The above link has a comprehensive list of all the documents you'll need.
