Hi! I know some might consider this as a dumb dumb question, but i would just like to ask if the Letter of Intent to Marry is considered as a primary or a secondary evidence? Do you get an RFE if you fail to submit one? And does the service center put the petition on hold until you submit the letter? thanks so much :)

Yes, you would get a RFE if you leave something out thats in the guides(usually).

We included letter of intent in our packet. It's not a primary evidence nor a secondary but one of the necessary documents. But I think others didn't include it in their I129F packet and didn't get RFE... And I haven't heard of anyone who got RFE just because they didn't include it... that's as far as I know. If you have it, might as well include it, if you don't, you might want to make one, but if you've already submitted your application without it... there's nothing you can do for now but wait and see...

It is not primary or secondary evidence of a relationship. It is a statement to USCIS indicating your intentions when a Visa is granted. Will you get an RFE if it is not submitted? It is highly likely, depends on the person working your case. After all, it is required and it is in the instructions for the I-129F from USCIS. There's really no reason to skip this. It is very simple to scribble a sentence or two. There's even an example here in the guides. Whjatever you do, don't start inventing your own rules unless you want to get an RFE!

Seemed like one of the REQUIREMENTS to me, rather than primary or secondary evidence. It only took about 5 min for me to write mine and sign it. Not a big deal. The longest thing about it was sending it to my fiancé in the mail.

I asked basically the same question in January and got a totally different response than you have gotten. I submitted without a letter of intent from my fiance but included one from me. I didn't have one from him because I missed it in the instructions and didn't wait for him to send one from Nicaragua. If you mailed the petition without a Letter of Intent to Marry I wouldn't worry to much. I was really worried but many people reponded to me that they hadn't included one from either party and were still approved without getting a RFE. I was advised that we should both submit on at the interview. Good luck! ^_^

I didn't have one from him because I missed it in the instructions and didn't wait for him to send one from Nicaragua. If you mailed the petition without a Letter of Intent to Marry I wouldn't worry to much. I was really worried but many people reponded to me that they hadn't included one from either party and were still approved without getting a RFE. I was advised that we should both submit on at the interview. Good luck! ^_^

That's interesting. I guess I just didn't want to risk our package being sent back - more waiting time. Maybe it depends on who goes through your stuff.

BTW, Nicaragua?! I was there a couple of months ago. Cool :)

Where were you in Nicaragua? I was there in Nov. :) It's a beautiful country isn't it!

Managua, Rivas, and Leon. It was so hot in December, and yes, a beautiful country; I stayed at an absolutely beautiful hotel. Very different though, but the people were SO nice even though I didn't understand most of them when they tried to talk to me (I felt bad!) And the taxis are amazingly inexpensive. Good old cordobas :) except calling cards and calling collect were way too expensive! :blink:

We got an RFE saying we lacked a Letter of Intent. It didn't tell us if it was mine or her's. They were both there in the original petition, but I had put them together in a clear page protector. I think they failed to turn the page and see her's was on the back of mine. But we sent two new copies, this time not in clear page protectors, just to be sure.

The letters are a requirement as stated in the instructions; so they are a primary requirement and are not evidence.

Yes most folks get an RFE when they do not submit anything.

A letter of intent is not mentioned anywhere in the I-129F instructions...NO WHERE. This site has it on their list.

The I-129F itself in "Part D" has the certification statement stating that you will marry within 90 days for the petitioner that you are required to sign and date.

I followed the guide on this website, so I included a letter of intent, but no where does USCIS ask for one, and I haver read a few post recently of petitioned being approved without a Letter of Intent. Is the letter necessary? Based on the recent posting of people that were approved without it, and the fact that it is NOT requested by USCIS I think the letter of intent added to the statement you are required to sign on the I-129F is like wearing a belt and suspenders.

Maybe at one time the I-129F did not have that statement included within the form and USCIS required a letter, but now.... :blush:

As for the beneficiary, during the visa process they have to complete a form that has that same statement within it also that they are required to sign. So even at the embassy end are letters needed... really doubt it. I, again have read recent postings of people going through their interviews and never being asked for those letters - most likely because they have already signed a statement within the application saying those very words.

My opinion? Nope - fact and I can provide links all day long .... or you can simple look up the I-129F and its instructions and then check YOUR embassy requirements, I know for the embassy my fiancee is going through its not on the list.
