Did not receive decision date in I-485 RFE acknowledgement update?

Hello all! I'm new to this forum so excuse me in advance if I placed this in the wrong section. Feel free to move me!

Anyway, I have a question that I cannot seem to find, no matter how much I search. And I wanted to join to see if anyone would have any insight to my question. Anything will be greatly appreciated. So here goes my journey story!

I'm a USC that met my wife last year in college two weeks before I left for my new job. After we met we were inseparable and I knew deep down I could see myself marrying this girl later on. She is on an F-1 visa, very smart and motivated young woman and she has future goals to go far in her career.

Earlier this year we decided to get married and that happened in July! Fast forward a month and I sent off the I-130, I-485, and I-765 packet. We decided not to file the I-131 as we would like to go visit her parents when she becomes a citizen. :)

So here is a quick timeline of our events.

July 2015 - Married

Aug 24, 2015 - USCIS received concurrent filing packet. (I-130, I-485, and I-765)

Aug 24, 2015 - USCIS sent reciepts.

Early September - (Can't exactly remember the date) Biometrics appointment for Sept. 25th

Sept - 16, 2015 - RFE sent out for I-864 (I goofed a little and had to redo the application)

Sept 25, 2015 - Biometrics done

Sept 26, 2015 - RFE response sent

Sept 28, 2015 - Package signed for after USPS Express delivery

Sept 30, 2015 - Online update received saying they got it and will continue on our case.

When I first sent the package, I sent it USPS express to Chicago, IL. My applications was then sent to MSC where it as stayed ever since. The I-130 and I-765 have been accepted and that's it, no updates. Only the I-485 has had any updates. This is the current update from the USCIS site, word for word for the I-485 update.

"On September 30, 2015, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSCxxxxxxxxxx. Our National Benefits Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

As you can see, there isn't a date of when I should receive a decision or when I should have a case update, like I have seen in other updates. It just says they'll let me know. My question is, does the 60 day rule still apply to me?I find it odd that they didn't tell me when I should hear something by. I know we are in for a wait, probably a very long wait because the local office is backed up. If you need any more detail, just let me know. I know I'm terrible at describing situations and I am trying my best!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello,

First, your situation sounds completely standard. I am in the same boat, though with slightly earlier filing and RFE dates. You are indeed in for a wait, so just go on about your lives. If there are no problems with your documents, the AOS applicant should get the EAD/AP combo card within the next 1-2 months and that would make doing so easier.

Not sure what "60-day rule"* you are referencing exactly, but basically at this point with the I-485, you are waiting for the interview appointment and there is little rhyme or reason when exactly to expect that. The USCIS processing times are what you are advised to go by to see whether you are within "normal processing time" for your local office. This provides some idea, but I have seen numerous cases listed here in which people get interview appointments sooner than what the processing times for their offices show, as well as a handful of cases where the delays are even greater than those times suggest.

So just hang on and don't obsess! :)

* There is a statement on the USCIS site mentioning 60 days (see below) if you want to submit an inquiry for a case that you think is outside of normal processing time. However, this is not a "rule" and the very next statement is that you cannot submit a case inquiry if it's been less than six months of filing (RFE resets that, so six months from your RFE receipt). So I'd call that the "six-month rule" more accurately.

NOTE: We are actively processing your case if, in the past 60 days, you:

  • Received a notice from us about your case,
  • Responded to a request for evidence, OR
  • Received an online update to your case status.
