Hi there, I am a non immigrant visa holder - tourist visa to be exact... My partner and I got married last week... Its my 5th month here in the US. i meet my partner here in the US. Anyways... Can someone help us what will be the initial step to adjust my status and to apply for my green card? What are the documents I needed and what are the things that we need to prove our relationship? Thanks...

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You're filing it together with the I-485 I presume.

So, your category should be © (9) since you're an adjustment applicant.

The fees for I-765 and I-131 are waived if you file it with your I-485. So, you just need to pay for the I-485.

Thanks.... In affidavit of support... What are the needed documents to be attached? And there will be two person who will give me affidavit of support my husband and my friend. Because my husbands income is not that high... Question, do they need to file separte affidavit of support or just in one form...?

Yes, they will need to each complete an I-864.

Your husband will need to provide his 2014 IRS Tax transcript (or 2014 W2s and 2014 federal income tax return), and he can include employment letter and recent pay stubs as evidence of income.

Your joint sponsor will provide the same things as your husband and they need to provide evidence of their legal status (US passport/birth certificate or green card). If they filed their taxes jointly with their spouse and are only using their income then they need to provide W2s too. If they are using their spouse's income then the spouse needs an I-864A and W2s too.

Thanks so much for your reply I really appreciate it... Another thing, on our marriage license i change my last name to my husbands last name... Question... In all forms i will going fill out, am i going to write my new last name or still the old one...

If you changed your last name, put the new one on all the forms. You'll receive your green card and EAD/AP card in that name.

If the form asks about any other known names, put your old name.

Yeah, you need to bring the form to a civil surgeon.

Use this link to find an approved doctor, https://my.uscis.gov/findadoctor

When you make an appointment, ask them what you need to bring in and what the requirements are

Thank you so much... I have question regarding the tax... My husband owes in federal tax or state tax not sure of the two, ... If we will be deciding to joint in tax application next year... Is the money he owes to the government will also be mine? If i get a job thru ATW, is the government will deduct big chunks of money in my paycheck to pay the debt of husband? Thanks...

The IRS or state government can't take your wages but they can keep your refund. File your taxes jointly and include the injured spouse form to protect your portion of the refund due to you.
