Well that makes me happy, they actually shorten the time.

She lives in LA so I guess California?

We need our good faith evidence when I go to the interview anyway, so timing is going to be right?

It's not based on where you live anymore, it's more based on case load at the service centers. When it was based on where you lived you'd gone to Texas.

You should still send in the good faith evidence with the I-129F petition, it's called front loading. It's not a guarantee that they will look at any of your good faith evidence at the interview, just go on the things inside what you sent and was (hopefully) accepted by USCIS.

More face time, more evidence then file.

We don't do face time, we talk 1-2 hours a day using whats up and msg all the time, and share pictures (well kinda sexy ones, do I add those to the file too? )

Is this good or we need to up our evidence game? Some postcards and plans, emails are on the way.

When we talk about face time we're not talking about the app, we're talking about actually meeting and hanging out. Going to visit each other :)

Give them non sexual pictures of you and your fiance together during visits etc. Pictures of you with her parents or her with your parents is a plus.

No one can predict how long it will take, processing time can change and you can get stuck in Administrative Processing after the interview.

I would say that it's better to build a strong petition rather than rushing it. I fully understand that it's hard to be apart but unfortunately that is something we're all going through.

Did your girlfriend (I assume you're not engaged yet due to the B2 denial and no proposal?) keep her boarding pass etc from her last visit? Do you have proof she actually visited?

If the B2 denial was recent I would definitely give it more time, let her visit and then file. It shows you're not desperate to come to the US and it will give you two a chance to gather more evidence.

Yes we have proof, we were together 2 times, first time when we met and second time 2 months later, she came back.

I went to the b2 a month later (5 days ago) and got rejected, we were planing to get married in the US but yeah, thats not happening, so we had no other choice than agree to do the k1 (or we can consider doing something other like getting married out of the us if that would be better)

Lets say I had no other choice than to propose via phone. And we made plans to spend a week together prior to NY.

So your intent was to go to the US on B2 and get married? That's not what that visa is used for...

When you get your K1 visa you go to the US and then you have 90 days to get married. Why not propose to her when she comes in 2 months? More romantic...

If you're going to get married outside the US then you want to file for CR1 (spousal visa).

It feels like you should take your time researching visa's before you rush into things. From what you just told me it doesn't feel like you know how the process works.

It was not, intent was to visit for a couple of months and be with a girl Iam in love. Im am not going to say proposal and manage were out of the option but certainly not intended at that time.

Now we are both stuck, and we are figuring out a best way to make it happen.

Considering you got denied 5 days ago I'd wait. It looks like visa shopping and it looks like you're obsessed with the idea of coming to the US. Not my opinion, I'm just giving you an idea of what the people processing your case might think. It will make it looks like you're super eager to go to the US and they might even think that your intent with the B2 was marriage which will just further add on to the suspicion of what your real intent is.

Got it, Thank You Very Much.

Ok than the best strategy would be to prepare as better as possible, gather papers, and start the process after this next face time 70 days from now :/

And hopefully the entire process will take not that long.

Wait to propose and to start the K1 process until after she visits. Otherwise, it very well could look like "visa shopping". You need to imagine that they deal with fraud literally every single day, often multiple times per day. You really need to stand apart from them. Unfortunately, lying about her not being your girlfriend could set you up to look like you're trying to beat the system.

Imagine for a moment that she really is just a friend, and her uncle or friend or someone owns a restaurant and they'd be willing to hire you under the table (why? who knows. Maybe because they don't have to pay undocumented workers nearly as much as other people. Maybe the restaurant owners is your mother's aunt's best friend from grade school. Anything is possible). You get denied this visa. Ok, so the easiest and cheapest way is out, how about you ask this friend to go for a fiance visa for you (the next easiest). They could easily suspect something like this. People do this *all the time*. In fact, I believe that the K1 visa is considered to be the one most vulnerable to fraud-- because it is relatively easy to get and the US citizen doesn't have to marry the foreigner if they don't want to. They never even have to see them again. Some people, all they need or want is to get through the border and they can live life below the radar indefinitely. You just don't want to get pegged as one of them. So, let her visit again, let your relationship bloom into something more serious so at least it looks plausible that you were once friends and over time developed a relationship. "Over time" is not 5 days after the denial of a visa, without being physically together. They very well may ask about this at your interview for the K1. I wouldn't suggest lying again.

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Considering you got denied 5 days ago I'd wait. It looks like visa shopping and it looks like you're obsessed with the idea of coming to the US. Not my opinion, I'm just giving you an idea of what the people processing your case might think. This is pretty good advice. After my wife's B-2 was denied, we waited 3 months and planned to see each other in Singapore. After our meeting in Singapore I filed one month later.
