Hi,

I have done research on this and I know the rules, however im in a unique situation. Any advise would be good.

I am moving to the US on a K1 in about 2 weeks - im getting married and applying for AOS/EAD asap. I know that I cannot work during this waiting time (3 months)

My UK employer needs my services for the next few months. It is a US based company and I worked for the UK branch

Is there any way I can work remotely for them while I wait for EAD?

I had planned on informing HMRC that I was leaving the UK (also to claim tax back).

I was discussing options with CEO and this is where we stand:

- They could give me a pre-paid bonus before I leave, take me off the books and I do some work remotely. Thoughts?

- Is there any way they can legally pay me while im there during the 3 months? Im assuming not through the US branch but if I dont hand in my HMRC notice, could I remain a UK employee and receive a check?

Any thoughts or suggestions? Essentially, they are looking for a way to pay me that does not harm me or them

Thanks

It's a grey area. There isn't a straight answer. This comes up often in the Canadian forums. One answer that often surfaces is that it's ok as long as it's not for a US office and the money is deposited into your UK account

Thanks. Any specific links to those? Or just head to Canada Forum

Hi there,

What did you end up doing? I'm in a very similar position?

Thanks.
