Doing AOS but NVC asks for $70 fee?

For those of you who are doing DCF, do you get a letter from NVC that asks for (1) a Choice of Agent and Address form, and (2) $70 of Affidavit of Support Fee after your I130 has been approved?

I am kind of confused. My I-130 petition for my wife has been approved and our I-485 interview date will be in April 2006 (we are doing AOS in the U.S.) But I got a letter from National Visa Center yesterday asking me to submit (1) a Choice of Agent and Address form and (2) $70 of Affidavit of Support Fee (they will then send me the affidavit of support I-864 form once the payment is cleared.)

My wife is in the U.S. and we are applying for adjustment of status in Oregon. I thought we just need to pass the interview and get her passport stamped and that will be all. Does anyone know what this $70 affidavit of support fee is about? Is it because that they mistakenly think we are doing DCF rather than AOS? Should I notify NVC that we are doing AOS?

We did submit a I-864 affidavit of support with our I-485 application and I am sure that $70 is not the biometric fee because we did that in December already. Thanks.

You cannot go in two directions... You have a choice... you can either a) do the I-485 or B) do the consular CR-1 visa route through the NVC...

If you have chosen to do the I-485 route, you need to let the NVC know this so that they can send your approved I-130 petition back to the USCIS so that it can match up with your I-485 petition...

There seems to be a little bit of terminology confusion. I think "DCF" has nothing to do with you, or your case. A DCF means you would go to your wife's country and file your I-130 there. None of the fees or forms you mention come into play in that case.

What I think happened to you is that your I-130 has been approved at the Service Center and sent to the NVC. They are beginning the process of an Immigrant Visa application for your wife because they do not know that your wife has already applied for AOS.

AOS and Immigrant Visa are two different ways to the same result (Permanent Resident).

You should not respond to those NVC forms, as they will lead to a visa appointment for your wife in her home country.

I do not know how to notify NVC of your choice, but the K-3 forum people might.

I think your original question was not 'do they think we are doing DCF', but 'do they think we are going for the immigrant visa (CR-1/IR-1)'.

I think you knew all of what I just wrote, except for the 'DCF' confusion.

Indeed. The NVC is not involved when an I-130 petition is submitted by DCF.

I suspect that meauxna is correct - you have not done a DCF.
