Hey guys

I had a very weird case I would like to share and tell me what do u think about the result of my second interview.

It all started 5 years ago I came to the us and few months later got married to my USC wife that I knew for another few months before that(we met online)

So 3 months after marriage we apply for GC, got the interview pretty fast even before the EAD.

Came to interview with few documents( I didn't have have SSN so we couldn't have much), pictures and with our attorney.

We got in it was BAD the lady was looking at us no smiling no small talk no questions just said show me documents and pictures. She looked at everything we brought and said "ok I'm going to separate you. The lady first".

Then she asked my wife like 30 questions and she answered all then I got in after like 20 perfect match answers she was like ok let's call your wife ( lawyer was there wrote the answers for each of us - he was HAPPY)

She said we obviously looked like a married couple she will go check some stuff and let us know. We all left happy.

13 months later we got NOID that basically talks about stupid stuff from the documents we provided like missing signatures and dates and for a home visit that they did to an address they found on my wife name and nobody was home and the lady from leasing office recognize only her picture and not mine. This apt was rented for my friend who couldn't provide income so my wife applied for him.

Anyway trying to reply with the lawyer and tons of proofs and nothing case denied few months later then Motion to reconsider or reopen was denied too and even the appeal for BIA denied(after 2 YEARS of waiting) - all for same reason of insufficient evidence since the beginning.

We filed again the i485 got fingerprint EAD and interview that happened few days ago. Again we are still married for 5 years.

So we went there with any possible document life car health insurance, lease contracts bills, tons of pictures and what not.

We got in the office was nice start asking questions from the huge files he had on his table from the big first file and the current one. Asked questions about marriage date date of birth where we live about the family like a lot of questions very slow. Then he asked why we don't wear rings and we explained him that we are planning to do another ceremony with rings in my country so we don't want and never worn rings yet.

Then he kept asking questions took some docs for himself like lease tax returns and some bills. Then he took me outside for separate interview it was quick he told my wife first that he's trying to make sure it's all real and she doesn't do me a favor or something she said of course not and he asked her only few questions and switched between us. Then when I got in he asked me how come I don't put a ring on my wife I explained him again same thing he asked me same few questions and I answered match answers so he called her in. He said he can't make a decision he had to go through everything see the history and he will let us know.

What do you think? Is there any hope they approve it this time? We are really exhausted from this all thing but oh well we have to keep trying until they believe us right :/

From what visa are you trying to adjust your status?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
