Good Afternoon

I had my interview on the 14th October at the London Embassy. Everything was going well however I was missing a few documents and was asked to submit a I-864 and a letter from my fiancee employer which I have managed to send in on the Friday.

My question is roughly how long will it take to get a reply as my petition is due to expire on the 30th October and I don't know what to do whether I need to advise anyone about extending this. Just to advise the embassy kept my passport until I send the docs to them and my status reads administrative processing on the CEAC Website.

Please Help :-)

So with regards to my petition expiring on the 30th October there's no need to worry?

If you trust an answer from somebody with a different visa who will interview in Islamabad, Pakistan.

There is something wrong with the information you have posted. A K1 does not do an I-864, so if indeed you blue form says that, you need to contact the consulate and ask some questions.

OK what happened was I totally forgot to bring the federal tax return with me and she said that the employers letter doesn't state how often she works or how much she is on annually though I supplied a few pay stubs so you think I should contact the embassy and ask?

A K1 affidavit of support is I-134. Did you provide that at the interview? And so they did not say submit I-864??

On your documentation an employer letter needs to state what she earns. A tax return is not required if you bring a letter stating her salary.

What has me confused is if the officer said I-864 and tax return required, she may have been giving you the spouse visa speech. They interview both and maybe she gave you the wrong speech.

I supplied the i134 stating her wage but the employer letter didn't state her wage. As it didn't specify this she said she doesn't know what wage she is on how many days she does etc

So she gave me a blue 221g saying I need to resubmit the employers letter stating wage,days worked etc as well as the i864,i864a or i864ez

I have resubmitted the employers letter stating her salary,hourly wage, hours a week and days worked, her federal tax summary from the last tax year and the i864 as well as the blue 221g for

Aha...I get it. You are mistaken. She was asking that you submit tax return forms which could be 1040, 1040A, or 1040EZ (depending on which one your fiance filed.) There is no I-864 in this discussion.

Also, a tax "summary" won't fly if they expect

a) complete tax return or

b) IRS tax transcript.

Perhaps you are using the wrong terminology again??

Ok so the blue letter starts like this:

Your visa application has been refused under section 221g of the immigration and Nationality Act, Section 221g prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the immigration and nationality act or related regulations. You may be able to overcome 221g pending:

The one ticked is = Submission of additional evidence (Please refer to the list below)

1) An affadavit of support (Form I-864, I-864EZ or I-864W) from the petitioner/sponser who filed your immigrant visa petition. If both the sponser and the spouses income are to be used to meet the minimum income requirements (not applicable for IR-1 cases) your sponsor and their spouse must complete the I-864A. Contract between sponsor and household member. To download complete instructions and forms visit the USCIS website.

2) A recent job letter listing job title, salary and dates of employment. Job transfers and signed signed job offers are acceptable.

What is crossed out though is asking for signed copies of us federal tax returns however i have sent these due to the I-864 i thought i had to sign was asking for last federal tax forms.

I do apologise if what i said before was confusing i am confused as much as you are. However i definitely supplied the I-134 Form aswell as pay stubs and have now sent the Federal Tax forms from last tax year aswell as a Employer letter stating everything they asked for i.e wage, days worked etc

This part is written to those applying for immigrant visas---

Your K1 visa is actually a non-immigrant visa being processed by the immigrant visa unit. You have been handed a form that would be correct for a spouse visa. It would require an I-864. And the I -864 does require a tax return. A fiance visa does not. But the fact that you already turned in an I-134 and you are supplying an employer letter verifying her job and salary, they can approve the visa and toss out what does not actually apply to you in the law. Either they can't be bothered to write a proper one for K1s or the officer picked up the wrong form letter. You should be fine. It sometimes takes them 2-3 weeks to get back to working on cases that were not prepared at the interview so don't panic if you don't get an immediate turn around.

Back to your original question. Your instruction letter that you received from London when your case originally arrived there, tells you that if your I-129F fiance petition has expired before your interview, you should bring a new letter of intent from the American fiance to the interview. I think you are okay without that because you did interview before the date, and your fiance has provided support documents since then that would indicate she is still on board and has not backed out of the relationship.

but I appreciate the compliment.

Glad we got that sorted so the rest on here won't freak out and say "I heard that London denied a K1 visa because they required an I-864 instead of an I-134." Your real problem was she claimed a job and income that wasn't fully backed up in the employer letter she sent you.
