Hey,

I've written quite a few posts tonight, since Monday and my approval I haven't really been able to sleep much. You would think that the peace of mind would equal a years worth of quality sleep, but I guess for me it is the opposite. I feel restless now, I have spent the last 3 years worrying about this, it has literally been the bane of my existence, it has defined how I live my life, and then suddenly it is over! I applied with a waiver because I got divorced while I was on the conditional card, I was already in the country for 8 years before this, I can't go into details regarding that, but all my friends live here, my life is here, my job! I expected a interview, maybe a bit of a battle. you see I have a DUI from my college days in Baltimore, but the ROC was as smooth as I could imagine, minus the delay. When I applied for AOS I spent $4000 on a lawyer, because of the arrest record, I was so nervous, at the interview the IO was like are you ok, I was shaking so bad! The lawyer proved to be a waste of money.

My father passed away while I was going through this. so I could not be with him when he needed me the most, one of the last times I spoke to him he gave me encouragement and told me that I was doing the right thing, if I had gone back to my country to be with him, I most likely would not have been allowed back in and my journey would have been over, so I stayed and he passed away. My approval on Monday is so much more then a letter or a webpage telling me that my card is in production, it is a victory over a failure that I will never forgive myself for. All of us in this section of this site have heart breaking stories, but I am here to tell you that everything will be ok! You will make it! Just keep calm. keep all your records you can and you will be able to make your life in this wonderful country. The night I learned I had finally become a permanent resident, I cried so many tears on my friends shoulder, because I felt like it meant more then just achieving a life long battle, it was the final option to really start my life. Dad, wherever you are, I'm sorry I wasn't there for you, but you know what? I at least have a reason now. I did it! For all you out there, I give you all my faith and love! This is not a monster system we are up against, they are reasonable and practical, just keep your records and submit all you have and you will be fine.

Sorry, I am rambling a bit, as I mentioned I can't seem to sleep now since this journey has come to its conclusion, to much energy, I should start writing like I always dreamed of. 3 years and it begins again with citizenship, I kind of look forward to that stress again!! haha!

Thank you to VisaJourney for existing and providing all of us with the help, advice, and experience we need. I know it put my mind at ease a lot. I'll try stick around to help anyone I can.

Thanks for your story and congratulations! I have welled in tears after reading this. My journey has equally been long and troublesome. I got my conditional residence in 2003 yet my conditions have not been removed. I filed one of the most difficult waivers to be approved (extreme hardship waiver) and on top of that, I applied for naturalization as the waiver is pending. Now I have an interview for both next month. I must say this waiver seems much more hopeful that my good faith waiver according to many lawyers who looked at my case. I knew my good faith would not be approved because of the myriad of mistakes I had made through the process. I am ready now and I feel confident in this one of course sprinkling some prayers therein. If all goes well in December, I will probably lose my man card as I will cry it all.

I know that it is not the same, but sometimes following your dreams, with your dad's blessings, is more important than being there physically. You and your dad were there for each other...every step of the way. Congratulations...now get some rest.

Mine was a mess. We were broke all the time and we were really never able to put up good documents together. She moved back to her home state to look for work and I remained behind, So the officer was expecting me to say that we were separated at that time but I thought separated means separating because you do not want each other in your lives anymore but that was not the case. When she asked when we first got separated, I gave her the time when we were on each other's necks and we parted ways. She however said that I did not tell the truth because we had separated at the time she moved back to her home state for three months. I did not count that as a separation since I was visiting her every two weeks but somehow the IO said I am not believable. I was a temporary employee (contractor) for the duration of our marriage so we really did not have much including no insurance yet she was sick. That also threw a wrinkle on my case yet I did not have insurance for myself as well. Provided all the documentation they needed but I was deemed not credible because of the insurance and the incredible definition of separation. I was then denied on that but then I refiled on a basis that does not require me to prove bonafide marriage as I don't think I will change their minds on that.

Congratulations Ian,iam going thru the same situation,I have applied for waiver in 2012,haven't heard anything yet,is it a good idea to wait or go for citizenship that can can trigger this decision???plz pls reply,!

Well said Ian, many congratulations, and I know your dad is up there looking down on you with all the happiness he has for you and his love. You did the right thing, I too am going through this long journey with hope, dispair, frustration, but, as you said, relax, slow down and it will be okay for all of us going through this long journey.

your case is somehow similar to mine.

I have been working in the same company in a different city (same state) from her(about 100 miles away) even before we got married so I was always home pretty much only weekends( 100 miles commute is crazy) throughout the 3 years we were married upto divorce

They did not make a big deal out of it at AOS despite me informing them. I have kept all toll tickets.

I have provided them with all these facts in the ROC and gave them both addreses

My concern now is that this may become a major issue now since they may think i simply didnt want to stay with her.i feel that that looks realy bad

the only insurance I provided that is joint is car insurance.apart from that, decree,some car titles, lease, bank statements( minimal transactions) life insurence and child birth cert(we have a daughter born 2 months before we got married)

I think you will be okay. You just have to be careful while answering their questions if they call you for an interview. Any small trip up might cause complications. Also be upfront with them from the onset. It gives them less ammunition if you volunteer such information. The fact that you have a child together and car titles together should help you a lot. Make sure you have all those toll tickets. Make sure you have a lot of photos of you her and the baby just in case. Was she not covered in your health insurance and the baby too? Life insurance? These should help though in my case the officer ignored them.
