I will answer the OP through pm, bUT I want to clarify some misunderstanding here because other victims probably will read this thread. I read at least 4/5 people saying that he left the USA he can't file VAWA,YES HE CAN FILE WHEN LIVING ABROAD.

Others saying he has no right to stay in the USA if his wife withdrawn form l864, well he still can file VAWA even with AOS denied.If he has any chance to have the VAWA approved is a different story and I can't say if he has a chance or not without seeing his charges.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm sorry, you applied for AOS based on your marriage, but at this point if she stops your application there's nothing you can do.

I don't know if you want to pursue a legal case with all the extortion and abuse you went through, but that could take months or even years (and a lot of money) to work out.

Best I can say is you probably should look at other options in applying for your green card (like the VAWA someone mentioned upthread), but since you consented on the charges of being the abuser that could get tricky to dispute at this point unless you have a more recent case that you could use.

Either way whether you end up in the US or back in your homeland you'll have to file for divorce for your own sake, and even that is messy and expensive. Best of luck to you.

As i have DV ticket on me as my wife and her parents alleged me for violence.

I paid the ticket online but i have to appear in the court on 16th dec to contest, or plead guilty or no contest.

I have below queries, If anybody can help, It will be great.

OR do we have any Criminal Attorney who can guide me well in this difficult time.

I have below options , which i have summarized..

My situation I (victim) was forced into criminal behavior by her abuser & I was Alone social isolation : broken my phone sexual exploitation. ECONOMIC AND EMPLOYMENT RELATED ABUSE IMMIGRATION-RELATED ABUSE Through open harassment, the abuser publicly demonstrates his control over the victim. Harassment can humiliate a victim by portraying her as weak and subordinate. Public humiliation may also be a culturally based form of extreme cruelty, particularly among cultural groups that highly value privacy. contest > can I contest without my presence as I am out of United States contest > is Video confrencing is the the option. contest > if i come , I feel unsafe...how can resolve that issue. contest > also what if i dont want to come to USA , my case will be weekended. and if i come what if USA ..i will need legal help and shelter help. contest > can this will continue in multiple trials in front of jury contest > will...witness be there or not. contest > how the trial will proceed.: Single day close or multiple days contest > What is the maximum punishment in this case...Can it be raised to ( Class B, A felony ) IF THEY PUT MORE CHARGES ON ME.... contest what are the various evidance can be allowed to prove that I am the real victim contest > How i can remove charges that from putting into my records. contest > what is the guarantee that they have not any other case on me, can we check from anywhere contest > also if my VAWA is approved my ticket will automatically down after my appearance. contest > is there any free service or NGO who can help me financially. contest > what if my wife withdraws immigration papers and i am inadmissible in USA. NO Contest > what if I say i dont want to contest due to my inablity to come USA..as I admissible..Will it go to my records or Arrest warrant NO Contest > what if I say i dont want to contest due to my inablity to come USA..or I have no money plead guilty > does Class C misdemonr or plead guilty will impact my VAWA application . paid but not stated .What if i don't go back to USA to appear in the court as I have already paid online the DV ticket paid but not stated > What reason to give i have paid the ticket....but my written statement is pending. paid but not stated > I have already paid the ticket , but not appeared in court, does it go into my records...if not , then only i can file VAWA Extension > how many months we can extend. Extension > how many times we can extend. Extension > on medical ground as my old parents need my support, and i am the only help for them right now. Extension > how i come to know that my appearance is being extended. Extension > can we plead guilty on any time before new trial date.

I'm far more interested in the father-in-law who "married for citizenship" and now appears to be "selling" his daughters to people who want greencards!

Hopefully, even if the OP isn't successful one good outcome could be that this person might be investigated.

Although I doubt it.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
