Will I lose my Temporary Green Card if my US citizen wife divorce me (or withdraw I-130)

I am Indian Citizen married to US Citizen in US without any condition of money or caste . We applied AOS and I got my EAD, my interview for temporary green card is awaited.

Her wife inherited US citizenship from her Dad who also married to US Citizen to get Citizenship.

I live with my wife and my mother in law(divorced by my father in law to gain US citizenship). My father in law lives in neighborhood with his US citizen wife (2nd marriage).

My Father in law now asking me 100K USD money for giving me green card.

My wife follows her dad blindly and do cruelty/violence on me. During 5th Violence instance, I called 911, but her parents, alleged me and proved that I did violence. Finally I got domestic violence ticket.

After that I managed to get out from USA safely with their consent.I paid my ticket online.

Now my wife cleaned joint bank account and not talking me.I anticipate she will stop my application.

I want to know my rights here, how can i save my green card as I left very good job in India and now unemployed in India.

I am looking for legal advice.

Can anybody Help to know my rights so that I can get on the basis of what i sacrificed.??????

Hi,

Sorry, you have no rights to a green card. If your wife stops the application, there is nothing you can do.

Divorce and move on with your life.

Best of luck

There is nothing u can do if she stop.

Family-based green cards are for the purpose of family reunification. If you divorce prior to the visa issuance then there is no family to unify, and you would not be entitled to a green card as a result.

Thanks all for replying.

My concern is that , I married with good intention of making a family, but now my in-laws asking money for giving me Green Card or doing violence. So now Do i have legal rights to protect my green card which i deserve as I am almost near to interview.

How do you deserve a greencard if you no longer have a basis for one? What's more important? Your marriage or your greencard?

Thanks everyone for your precious suggestion.

I agree my in laws lied and gave evidence that I did violence and i got a ticket which i paid to avoid further court issues.

but I have old mark of nails on my arms of my wife as proof of violence and few recording where my in-laws talking about 50 lacs of money for the green card or They want somebody who can value green card.

Is above things are adequate if i apply green card based on VAWA.(As a battered spouse, child or parent, you may file an immigrant visa petition under the Immigration and Nationality Act (INA), as amended by the Violence Against Women Act (VAWA).)

Why did you leave the US? There is not much you can do like fight the domestic vilolence or sue her now.

And you left without green card abondoning any help

as you stated above:

After that I managed to get out from USA safely with their consent.I paid my ticket online.

you need to forget the US

Sounds like the OP has paid good money and been stiffed, some sympathy from other posters could be in order.
