Hello,

My husband (Green Card holder) and I are about to send in the RoC paperwork, and we would like opinions from VJers on whether we have sufficient evidence. Here is what we have prepared to send:

  • Cover letter, Check for $590, completed Form I-751
  • Copies of his Green Card, Brazilian Passport, and Ohio Driver's License
  • Copies of the Final Decrees of Adoption designating my husband as the legal father of our two sons.
  • 2013 and 2014 tax return transcripts showing our joint returns for the past two years.
  • A copy of the deed to our house showing joint ownership.
  • Copies of bank statements for our joint checking and savings accounts and our credit card statement.
  • Copies of our auto insurance policy and health insurance cards showing joint policies.
  • My husband's 401k listing me as the primary beneficiary of his account, and our sons as secondary beneficiaries.
  • Photos of our family dated from our marriage through the present time. (3 pages of pics -- 7 pics per page with descriptions and dates -- each page is organized by year.)

Our credit card was mine before we were married, so I added my husband as an authorized buyer when we married in 2013. Statements only list me, so I submitted a screen print of the Authorized Users page. This past month, our credit card company began listing purchases by users. So Sept 2015 shows purchases under his name, but all other statements lump us together and only list my name as the primary user. Do you think this will be a problem?

I have included the summary page of 7 checking statements and 7 savings statements ( September, January, and April statements for the years 2014 and 2015, as well as September 2013) I am hoping this shows that our account has been joint since our marriage. Should I print a statement for every month, or does a few from each year seem sufficient?

I do have life insurance policies of which my husband is the beneficiary, but I do not have the paperwork showing this easily accessible in the next few days. (I had hoped to submit on Oct 22.) Do you think my evidence is strong without life insurance information? (Particularly the fact he adopted my children, making him legally and financially responsible for them. I would think that evidence would be pretty strong.)

If more evidence would be prudent, I could delay our submission to collect more, but if this is strong enough, I would like to not delay.

This is pretty good, but consider crafting wills, medical powers of attorney, and similar documents. These make excellent evidence for ROC, and they're even more crucial to have in "life."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

you seem really good to go! I think you have enough and will be approved without RFE or interview, I'm not a lawyer, but just basing that off my own previous experience. I applied for my ROC on my own due to divorce and included the following:

The following are the description of the attachments in the submitted order:

· Form I-751 waiver based on marriage entered in good faith but terminated through divorce.

· A money order for $590 payable to US Department of Homeland Security

· A copy of my permanent resident card.

· A copy of my marriage certificate.

· A copy of my Divorce decree.

· Copies of Arrest Records

· Copies of our joint Tax returns 2012, 2013, 2014

· Copy of our Drivers Licenses

· Copy of joint insurance cards

· Copy of joint ATT phone bills since marriage

· Copy of joint Time Warner Cable Bills since marriage

· Copies of past 3 leases

· Copy of joint HSBC credit cards plus statements since marriage

· Copy of shared Chase bank account since marriage

· Superfluous mail sent to either of us at marriage address

· Various photos of our relationship

Copies of documents submitted are exact photocopies of unaltered documents and I agree to submit original documents to an Immigration officer or Consular officer at a later date, if required.

I was approved on Monday by getting an email saying my new card is in production. By all means, keep researching, but in my humble opionion you have a soild package. I read somewhere that %90 of ROC get approved without interview, don't quote me, this is the internet after all, but I look forward to hearing about your approval. :)

EDIT: with regards to bank statements, I chose 4 a year for the past 3 years, so 12 in total, you can never send to much!

This does look good, but if a few days won't hurt then get the life insurance documents. Throw the kitchen sink if you have it!
