DS-260 Question "Do you seek to enter the U.S. to perform skilled or unskilled labor"

Hi Guys,

My husband and I are still struggling with the following question:

• Do you seek to enter the United States for the purpose of performing skilled or unskilled labor but have not yet been certified by the Secretary of Labor?

I see that many people recommend answering "No" to this question, as they are moving to the United States to be with their spouse, who is already living in the U.S, and not for the purpose of finding a job. However our situation is different because we are both living together ALREADY in Spain and we are, in fact, primarily moving to the U.S. because my husband's job prospects are much better there (he is an aerospace engineer, hence lots of work opportunities in the U.S.).

I haven't seen anyone suggest answering "Yes" to this question. However, I am wondering if we should, and how important it actually is. Will we have a chance to explain this in the interview?

As far as I recall the answer to that question should be "NO". The PURPOSE of moving to the United States is to be with the spouse, period. They obviously know that once in the U.S. with the spouse he will be a productive citizen and become employed etc. however that is not why he seeks to enter the country. Does that make sense?

What catagory Visa do you have to US ? or do you have a EU passport.

I live with my husband outside of the country (soon moving back to US now that he got his immigration visa!), we answered no and there was no issue whatsoever. At the interview the CO asked what are our plans to establish a life in the US, I answered that I was not planning to work but we were going to move into our house, register our son for school and that my husband would look for a job. That seemed to satisfy her.

Answer "No," the purpose is for legal immigration based on family relationship, not illegal labor (and I suspect this is what the question is really asking).
