Green Card Stolen Before Naturalization Interview

Timeline

My wife`s Greencard was stolen along with her passport. We are still awaiting for the naturalization interview letter which should be coming anytime now. I still have digital copies of both her Green Card and Passports. As it could take months to get these replaced would my option be to postpone the interview once the letter comes in? We have already filed a police report today and are keeping our fingers crossed.

Why do they even need a GC I don't know. They can run the fingerprints and ID a person and find out if you are a PR without any paper ID on you.

Expect some delays in processing unless there is a specific duigeline how to deal with this kind of situation.

The truth is, the Pilgrims were Puritan fascists who were only looking for their

I say with very little exaggeration, that living under Puritan rule in the New England American Colonies would be nearly as religiously oppressive as living under the Taliban in Afghanistan, or Wahhabi ruled Saudi Arabia. We think the old man they crushed under stones for refusing to submit to their trials was the result of some abnormal paranoia due to the bunker mentality of a pioneer colony in a harsh new land. When we read about the dozens of fellow colonists they just let rot in jail for months as they queued them up for their American Inquisition, we assume that this sort of fiendish treatment had to be the product of some sort of atypical mass mental illness brought about through a bad diet and not enough sunlight. We both came back from Punta Cana and as we stopped by to grab something to eat someone broke in to our car and stole our purse and carryon. It's unfortunate cause now she doesn't have any id. Since her drivers license was due to expire next week they can't renew her drivers license without her 10 yr physical green card as the drivers license was granted to her using her 2 yr conditional. First thing we may have to do is get a new passport and go to the interview with hopes of them accepting her without the green card. It doesn't make sense having to wait another six months just for the green card if her interview will take place well before that. We are awaiting for the police report as well as uscis to have infopass availability. We are also waiting for the interview letter to come in.

A. Your wife can naturalize despite her not having a green card. She is still a permanent resident. A permanent resident whose card whose card was stolen, lost or expired, can get U.S. citizenship without getting a new card.

Some people are confused about whether a naturalization applicant needs an unexpired card in hand, to naturalize. If you ask USCIS officials whether a person with an expired or missing card must replace the card before naturalizing, many will answer “yes.” But that’s only because the law says you must always have a valid card. However, if you ask USCIS whether you can naturalize without a valid card, the answer is again “yes.” A person with required number of years of permanent residence, can clearly naturalize without producing an unexpired plastic card. Your wife will need some form of government-issued I.D., such as a driver’s license to prove her identity. Evidence that she is a permanent resident will be in her immigration file.

It's not very likely for someone to answer your question here, because someone from the same state as yourself (and who is familiar with local VA DMV rules) must read your question and come up with an answer. I live in MD and have no idea how I can replace my DL if someone steals my vallet with GC tomorrow. Most people wouldn;t know unless they have been in exact same situation.

There are a few things you can do though. One is to pick up the phone and call your local DMV, or visit it in person. If clerk is inept ask to speak to a supervisor. Explain them that your spouses' GC was stolen. I am sure you will need a proof (such as Police report). Then ask what can she do to get a replacement DL.

You can also Google it yourself and see what search results you come up with.

When we went to the dmv they refused to renew her drivers license as she did not have the physical green card. When I called they stated that a i757 was enough but the problem is that the form didn't have a expiration nor a issued date. It just said that her greencard was approved. We will try again with the police report but if they end up giving us a hard time about it we may have to consult a lawyer for further advice

First, find out what the law is. Often, it's enough to find the specific statute (or instruction page from DMV) which states you are entitled to DL based on so and so. If BY LAW you CAN get replacement DL with I757 (and certainly Police report), then print out where it says so, and keep it in your pocket. Go to DMV. Present documents which you know are sufficient to receive the document you need. If clerk is inept, show the print out (law, statutes, instructions, etc.).

If it still doesn't work, then call floor supervisor. If BY LAW you are entitled to it and they refuse to process your request, then you can file formal complaint against DMV. They should have a special customer care line.

In any event. I think if your spouse is entitled to passport and can get it in US, then she should go applt for it without wasting any time. If you can get DL , great. If not, then at least she will have some gov issued ID to show, so she can attend the interview.

I wil not respond to this thread again, but I am sure you already know what you need to do.
