Good evening everyone,

I have arrived to the US in January on a CR1 Visa, I am in a real marriage and my wife and I love each other. Lately, she started to have mental problems and she is going to counseling and she's on anti-depression and anxiety medication. Some times her mood will change and she will be a different person, she wont talk or she will be crying and sitting alone. She have a history with mental problems and she was diagnosed with BPD she was 9. She lost her job because of that and I am the one who is working and taking care of the bills, her doctor was talking to her about applying for permanent disability because that's the 3rd job she quits because of her condition. We have joint leases together,joint bank accounts and the utility bills are in our names.

Some times she will tell me she wants a divorce, then later she will tell me she can't live without me and she loves me. She is unstable at all and she is swinging my life left and right, up and down. Especially when she imagines things which are not really happening but she acts as if it's happening or happened.

I am almost in the US for 1 year and almost married for 2 years. My question is will I be able to file for removing conditions alone if she wanted a divorce? or if I want a divorce because of what I am passing thru.

I tried helping her and supporting her but she keeps imagining things about me and herself which are not true.

I appreciate any advice or information.

This should be moved over to the ROC section. Short answer is yes, you can file ROC on your own if you happen to get divorced as long as your marriage was in good faith.

Thanks for your comment. My marriage was entered, and still in a good faith. I am trying to help my wife in all the ways I can. But I wanted to learn more about the law. Just in case she wanted a divorce in a moment of her's.

One issue is whether she will attend the interview, if there is one. (Or I guess if she is this unstable then you don't know beforehand?) If there is an interview and she refuses to attend then you will have to divorce.

No, my question is if a divorce will happen before the 2 years and I want to file for removing conditions alone. Will she still need to attend an interview if we are divorced?

Go to bpdfamilies.com you will get lot of answer. honestly speaking life with bpd is rollar coaster. It will swing swing swing and just swing. The treatment is possible but it is not easy though if patient is not coperative. They fall in and out of love. When they are in love they love you like crazy and you will become center of their world. But when they fall out of love watch it you will be treated as garbbage. They will go for an affair and then they realize that oh this is not life they want. You need to be very careful. Do not run into any arguement, you won't win and other you will hurt her and she will again fall out of love. Some people try their whole life to control situation and live with bpd but it is not easy at all. Read the book called "walking on egg shell".

My soon to be ex was bpd and I lost everything. Very late I realize that I was walking on egg shell. Secure your finances and if you can take her to get daignose. It would not only bpd it also include bipolar depression of quickly quiting the job. If you have any question send me a message. Good luck .

With divorce also it is possible to remove condition, you just need to have waiver, if you can show enough proof of real marriage.

So true. In years past I dated a foreign woman in her 20's for a few years, we even went as far as K-1 approved and she arrived in Los Angeles but because of travel and environmental changes (IE different country) and her meds well within one week she swung hard and quick and I put her on the next flight back to her country. Only after this all did I understand the life of a person with BPD. WE stay in contact from time to time. I have compassion for anyone dealing with BPD and their family, spouses and friends.

In the event of a divorce, you will be able to apply to remove conditions on your own with a divorce waiver. You seem to have plenty of evidence of a good faith marriage. She will not need to attend the interview if you are filing with the divorce waiver.

So true. In years past I dated a foreign woman in her 20's for a few years, we even went as far as K-1 approved and she arrived in Los Angeles but because of travel and environmental changes (IE different country) and her meds well within one week she swung hard and quick and I put her on the next flight back to her country. Only after this all did I understand the life of a person with BPD. WE stay in contact from time to time. I have compassion for anyone dealing with BPD and their family, spouses and friends.
