Hello! I'm sorry if these questions have been asked before. I've read through so many posts and so many instructions/documents that my head is spinning because of overload.

My husband (American) and I (Belgian) recently got married 2 months ago here in Belgium. Our journey started when we first met each other back in 2010 while I was in the US living and working for 18 months. He has now been living with me in Belgium for 1.5 years and now we are planning our journey back to the US together.

Our questions are:

1. Will we be able to file our I-130 petition via the Consulate overseas in Frankfurt, Germany using the DCF procedures since my husband has been living in Belgium for more than 6 months? Or does the Consulate in Frankfurt only pertain to Germany residents?

2. If we can not petition using the DCF in Germany, is the Chicago Lockbox our only other option to petition for my immigration process?

Thank you in advance.

We are in NL and originally hoped we could do DCF in Frankfurt, as I had been legally living abroad on an EU visa for more than 6-months. We made a request but were almost immediately denied.

However, the entire CR-1 process has only taken us 4-months to complete, which ends up being around the same time as a DCF case would be anyway. So basically, if you've lived abroad for >6 months and file through the Chicago Lockbox, you will automatically get expedited through much of the waiting.

Good luck!

Hello, I'm an expat living in Belgium!

So my husband and I had our DCF interview today (we got approved)! The whole process took less than 30 days!

The thing is that legally living abroad is not enough to be eligible for DCF, in our case my husband got a job promotion that required him to move back to US until January/feb 2016.

This document shows in which circumstances the petitioner will be eligible for DCF : http://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2012/May/DOS-I130May1412.pdf
