Don't wait too long. Quick action is needed. Send them info regarding the religious differences. Have family/friends do the same. Once it's sent back it will be left to expire.

I emailed them and they did not give me any answers besides just that the case is sent back and we should contact the USCIS. so, i guess my only option is to go back to india get married and then apply on spouse visa (I-130).

So if you could update how your case ends and what evidence you gathered to prove that your were single would be greatly appreciated. I think I might of made a similar mistake and I would love to prepare for that issues that might arise.

My issue is not that I had a ceremony but I stupidly submitted my New Delhi lease which states me as a wife (Thought it would help to show that we lived together but our landlord wrote that I was a wife because two different sexes are not culturally allowed to live together in New Delhi without being married and I included this information on a post it stating the reason why I was listed as wife.) Also provided two notarized affidavits that we were single and mine has the seal of the US embassy in Delhi that were signed two weeks after the lease date.

So please any update would be greatly appreciated from a fellow India visa applicant.

I am sorry about your situation. I emailed the embassy/ support@usatraveldocs.com and they simply told me that my case is sent back and did not answer my questions i had written in the email. I did call the USCIC and asked about my case they did not receive anything from the consulate in india. i also asked if i go ahead and get married what happens to the K1 application and she said it would be voided. So, both families are trying to figure out what is the best option if to get married and then apply for spousal visa. Do you know or heard that the case sent back would pose any effect on the spousal visa?

Petitioner should contact the senator immediately and through him request a second interview and you and the senator should also

forward to the embassy the differences in the Hindu and Punjabi customs. If you claim it then back it up with written evidence from a reliable source.

If the case was already returned to USCIS then it will expire and you can move forward with plans to marry and file a CR1, this will NOT

negatively influence your next petition whatsoever.

yeah that is hindu wedding, but this was a engagement (punjabi) and it is used then.. as a ritual.

Marry and file a CR1. It doesn't matter when you hear from USCIS, your K1 will expire and will not be reviewed, no matter what the expiration date

is. Stop waiting for the letter of expiration that you will receive in about 6 months. Just because it gets to USCIS with another 4 months extension means nothing,

they will NOT review it but store it and let it expire. If the embassy refuses the visa then they won't extend the validity of the petition and even if they did,

it doesn't matter. Don't beat a dead horse and move forward with a CR1 and yes, of course the K1 is void when you file a I-130, there is nothing

you can do to keep it alive, if you marry or not.

I think, if you marry, it will prove that you are both committedand if you can explain what happened during your CR1 interview about the rejection of KI ( If they ask), you might be okay.

However, both of you know that marriage is a serious event and if your marriage visa is not approved ( not to scare you), then are you willing to move to Fiancee's country or to a neutral country, just a thought?

They will most likely give you misinformation and confuse you even more. I would make an inquiry to the embassy through the senator and get the diplomatic

pouch number in which it supposedly has been returned so you are sure it's not sitting in internal embassy AP.

I have not contacted the senator or congressman. I called USCIC and they have not received the case yet. I asked if i could marry and he said go ahead and get married and apply but keep track of this case. Once the k1 case is in the USCIS system I can send them a letter canceling the case. To confirm what he told me i called a lawyer and he said not to get married instead fight this case. So that i dont get fraud case and it will impact my spousal visa. I am no confused as to what to do. Someone please help me.

Your lawyer is an idiot. K1's do not get denied at USCIS, they are expired on purpose and therefore don't carry a fraud PC6 hard marker. It will not influence CR1. Research deeper with Marc Ellis' articles on the lawsuit which stopped the automatic fraud marker on returned k1's. I told you previously to contact your senator asap if you want to fight this and inquire through him for a second interview and then submit proof that your cultural custom was not marriage. If the case has already been returned then nobody can do a thing to fight it, no senator and no lawyer milking you for your money.

For sure he was! I do not want to go through the route of getting a senator involved because it will take long time. The USCIS guys said the case could sit in india for 180 days. I was shocked to find that out. It is difficult to decide what to do. I did look up Marc Ellis and called the number on his website and left a message. Lets see if he calls back.
