Canadian citizen entered the US legal, is there any need to file a 1-131 if he has no immediate plan to travel outside of the US?

Good Day,

I just want to make sure I am correct in my interpretation that I do not need to file I-131 for my husband. He is currently in the US legally ( B2 Visitor) and does not have any immediate/known plans to leave the US.

Secondarily, if things were to change and a reason for travel presented itself, I could then file the I-131 at no charge since I will have already filed and paid for I-485 and I-130.

Nope, file all at once or you will have to pay the charge. It's free when filing concurrent so why not do it all at once just in case?

Ok so I will have to pay if filed at a later date. My understanding is that I cannot file it concurrently at this time because we do not have any advanced notice of any travel that would be necessary. From what I am gathering from the form, they need specific travel information should at dates and intended destination.

Whether you file the I-131 and/or I-765 concurrently with or subsequent to the I-485 they are still processed without charge.

AP is routinely granted for people with a pending I-485. You are not required to give travel dates or a reason for wanting the AP.

You should apply for it just in case.

Not true. You can file later at no charge if you have a pending I485. Go ahead and do it just in case. We had no travel plans so in that section we put something like To be used for emergency purposes only.
