Hi everyone i have tried to find the answers to the following questions but have not succeeded.



My fiance has just started a new job and our case is en route to NVC, so i have a few questions:



1) Because he has only been employed for a month does he need to include his assets and real estate on the I-134? He is earning above 125% but he has no pay stubs yet.



2) Is it ok if he just states his annual income?



3) If he includes his assets does he need to include proof of said assets like title deeds etc?

No need to include assets if the current and continuing income is enough. You ought to send an employer letter stating position, pay rate, and length of employment. Was the petitioner employed previously? If so, submit some pay stubs and a letter (if possible) and then at the interview have recent pay stubs from the new job.

Thank you very much.

My fiance was working in Korea in 2013- 2014, so he does not have tax returns for that year. He then worked from October 2014 to January 2015 at one job and January 2015 to May 2015 at another. He does not have pay stubs for any of these.

He was unemployed from June 2015 - September 2015

He just started working in the last week of September.

As a US citizen he still needs to file taxes regardless of where in the world he earns the money, provided it's above a certain threshold. I believe it's around 10,000 or so. If this applies he will need to get this done ASAP. Assets can be used minus any liens against them. Primary car can't be used though.

Ok i think i'll just tell him to not include his assets.

He needs to sort out the tax return too. US taxes on worldwide income. There are tax treaties that avoid double taxation. But a tax return must still be filed if the income meets the filing minimum. This will very likely trip you up at the Adjustment of Status stage if it isn't picked up at the Embassy for your interview. If it happens there at the Embassy then it's possibly a big delay which I wouldn't want to endure if I was once again in your K1 shoes.
