I have a question for my friend about to start her AOS process, basically she has a couple of questions and I thought someone here might be able to help her out, her husband has 4 children which are in the custody of his ex spouse and he is not financially responsible for them, infact his income is quite low and he doesnt qualify to file taxes. now her questions are;

1) since he is not financially responsible for the children does he need to include them in the i864 since they are not dependent on him.

2) She is still employed by her employer in her home country and is being paid as she has always worked from home, is it possible for her to be her sponser and what would she need to do to show this.

12/24/2014.................forms i130, i485, i765, i131 mailed via usps12/26/2014.................forms delivered01/05/2015.................NOA1 for all forms wth 26th dec as priority date01/24/2015.................bio apt received for 02/0601/26/2015................. walk in bio failed, supervisor said that the office is way to busy to come back closer to my apt date02/06/2015................. completed biometrics02/11/2015.................Aos status update 'case is ready to be scheduled for an interview'<p>02/24/2015................EAD updated to 'card in production' AP updated to case approved

09/17/2015....... interview scheduled for OCT 21st.

10/21/2015....... attended interview, approved on the spot, also received updates on case status.

10/23/2015...... green card mailed

You didn't read my question properly, I know she can help the question is how does she show the income continues, her English is not good enough at the moment for her to sign up to VJ.

You clearly asked if she could help sponsor (" is it possible for her to be her sponser") which is in the instructions that need to be read first.

I didn't answer " and what would she need to do to show this." Think about how you could prove in writing you have a job. What would you use as a good proof? And what if you were changing countries? Can you think of how you could get something in writing that says you will still do that same job and be paid in the new country after you move. Who can write and sign that guarantee that they will continue to employ her?

Minor children are included in household counts regardless of where they live or who claims them on a tax return. The original questions is a bit confusing so I can't tell who is what (petitioner, beneficiary, joint sponsor).

To use that foreign income the sponsor would have to give evidence that the income would continue. A letter on company stationary and/or a work contract may be good evidence. Yes, those would need to be in English or be accompanied by a certified translation.
