Hello,

Firstly, apologies in advance of this is out there somewhere - I'm struggling with too much info on the net, without all of it being accurate or in-date!

So, happily just got married on k1 visa and looking to go through AOS. We have most things together, but he's struggling with some tax info for supporting documents for I-864. I need my EAD ASAP as I have a job lined up and waiting for me. Can I now go ahead and apply for EAD separately, before the I-864/AOS? Would there be extra costs or delays/ issues with the process if I did it this way?

Thanks for your help!

Nope, you can't file the I-765 without first filing the I-485.

You can try and expedite the I-765 once AOS docs are in order by evidencing financial hardship if you lose the chance at the job you have lined up.

This may help. It says that technically you can but it would be a waste of time and money.

Agreed.

Ditto. The EAD expires the same day that your I-94 expires so it is a waste of money. Besides, it is free when you apply for it with AOS.

You can apply before AOS, but it will cost you $380, the EAD will only be valid as long as your I-94 is, and it is not renewable. It takes 60-90 days to receive, so you will not have much time to work using it. It is a complete waste of time and money to do so.

You should go ahead and file for AOS along with the EAD and AP at the same time. The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485. Then, ask for an expedite based on a job offer.
