I have been denied visiting visa last year the K-1 visa last month since my fiancé is too busy at work and can't kam anytime soon can I apply for student visa? Or it will just put me under red flag? We miss each other so much and it feels like forever to wait for the marriage visa for getting married in my country and filing and waiting for that

Noa 1 August 15th 2011
Noa 2 March 2nd

NVC case numbers March 22nd
My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30

Current record holder of fastest through the NVC :D

Medical exam in Stockholm April 13th
Interview on May 16th !!!
POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

October 23rd 2015, Oath ceremony!!!!!​​

I was denied both visiting and k1 visiting b.c you don't have strong tie with your country and k1 was age difference but the officer covered it up as "inadequate evidence but we had everything from ticket to letters I mean everything

You say your fiancé can't come anytime soon. Maybe he has to make time. Spend more time together gather more evidence and then get married. Right now that's your only option.

I doubt the "inadequate evidence" was a coverup or excuse. Major age differences can raise red flags, thus substantial proof may be needed to show a bona fide relationship.

Work to gather more proof- more visits, etc and try again. Or get married and go for the spousal visa. You don't need to have a big affair, just need to be able to show a legiate marriage.

I heard they wil still denied you if you don't have big wedding like they do background check in your area and ask everyone if they know that that person is married

It doesn't have to be big. Just invite whoever you were planning on inviting.

I guess you could try to do the K1 again with more evidence but it's usually a tad bit easier to get the cr1 approved

Not true!! My sister was married after getting denied 3 times visiting visa and k-1. But after they got married and applied for spousal visa they wr approved .Not a big wedding like ur talking bout. They went to court and sign n have only family on their marriage party. It took her like year but finally she got the spousal visa

The original OP regarding pursuing a student visa seems precarious.....particularly for the end goal of marriage and staying in US

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Student Visa is a non immigrant visa.
