I see all the NOA2s on here and I cant help but wonder how many of these had IMBRA waivers included in the petitions. I'd like to see just how much this slows down the process. TIA

I did not have an IMBRA waiver in my petition but I know someone who did (2nd petition within 2 years), and he filed about 20 days before I did and was approved 3 days before I was....

YMMV

:) You're just the guy I wanted on this thread being that you are the monthly stat master! I've seen a couple timelines with IMBRA waivers...one that took 8 months...but I also have a 601 to file at the end of all this so my journey will probably be near completion when Im 93 years old. (Im 34) :(

Well, mine doesn't seem to be going very well. I sent the K-1 on the 14th of December to Vermont. My NOA-2 was January 22nd. Most take about 2 weeks. I was notified that my name had been added to a Database of Multiple filers. From then, absolutely nothing. I have not received any notices from NVC. One other guy using Vermont with a fiencee from Russia and with a NOA-2 date the same as mine has his interview on March 25th. I just have to assume the IMBRA waver is slowing it down but I really thought if it did slow it down it would be in Vermont.

I had decided to wait until the end of this week (tomorrow) before I start trying to find out what is happening. Anyway, that is my story.

HI there, I posted in IMBRA once my petition was filed. This is my second K1 in 2 years; I sent in Paperwork 1/25/07 and our interview is 5/10/07. Less than four months - praying that we get approved. I don't know if it necessarily slows you down. The good news is that people are getting approved!

good luck to you.

1st K-1 Journey:

June 2005 - filed

October 2005 - visa interview

March 2006 - AOS packet mailed

DIVORCED

June 2007 - Interview

2008 - 10 year approval

--------

2nd K-1 Journey:

07/28/07 - AOS paperwork mailed

07/30/07 - Received at lockbox

09/18/07 - Biometrics

10/15/07 - Transferred to CSC

01/09/08 - AOS approved w/o interivew

I filed my petition with a request for an IMBRA waiver (2nd K1 in two years, but for the same beneficiary.) As my timeline shows, we got the NOA2 in the same time as most CSC filers, and it has passed through the NVC quickly and smoothly.

IMBRA is predominantly a USCIS issue and once it is approved and moved on to NVC should have no affect on your petition whatsoever. However, that does not mean that other issues won't arise at NVC when they process the name check (or whatever it is they do at NVC)

My petition hit NVC on the same day as another VJ'er... My petition passed NVC in two days and his is still there pending additional review....

Have you called or e-mailed NVC for an update?

I had a previously approved petition ( not all the way approved) and a former marriage case where I stopped the guy's greencard ( 2 cases in the last 6 years) so watch my case because I submitted a request for a waiver with my 129F petition. I got a very weird message that my old cancelled case had been received at the service center and at first I was confused.

Is any one else dealing with an approved case in the last 2 years that had to have an IMBRA waiver? How long are they taking ( IMBRA waivers)?

Hey don't feel bad. I have a former marriage case where my beneficiary beat the ####### out of me and I cancelled the petition.

Then 2 years ago I petitioned for another boyfriend and he got approved but then decided not to come here ( approved March 7) day after imbra started

I finally fell in love again and right when I did, they stopped taking consular filings and then imbra kicked in so I am sitting in the middle of a pile of papers and no idea where to turn next. I want to cancel this petition and then file a K3 cause I just want to be with him so bad ( its been 5 months) I am so scared I will lose our relationship if I have to file a new case and then cancel this one but I am hearing so many nightmares about interviews and people that are legitamate couples being turned down for stupid stuff and then I am looking at the wait times. I have talked to several attorneys and they are telling me to wait out the fiancee visa and the waiver process because the marriage visa is taking forever too and then I could end up cancelling one case , starting another and ending up underneath a pile of papers. We don't set out to make a mess of our lives.. but oops. Has any one had any luck with imbra and the less than 2 year appeal? Did any one else see a notice for an old case being sent back to the service center for review? I got the receipt and I freaked cause I thought it was my new case and here I am getting a receipt for a 2005 case that has been closed a year. Do they always do that.. send old cases back to go with the new ones? Or am I the only weirdo on here with a mess on their hands?

so he's not as in love as you are? He won't stay with you if the petition takes too long? Huh. Interesting. And trollish, among other things.

along with dcf was stopped after imbra, not prior to, as the above stated.

This is my second petition for the same beneficiary within the two year period, as the first petition was denied at CSC level. I did not want to take a chance in case some incompetent ####### reviewing this petition does not know how to interpret the IMBRA law, so I requested a waiver along with petition #2.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

If a statistical sample of one is a trend then you could draw that conclusion... but then again TracyTN filed one day after me and was approved 30 days after mine and she did not have any IMBRA issues...
