Need help about filing please?

hi everyone! I'm starting to fill up forms since I'm petitioning my husband and 2 kids (3 and 1) I've been living in th Philippines my whole life and have only been travelling to the US for about a month per year, I got my citizenship from my Father who's an American. I'm so worried about getting denied since I haven't been staying much in the US after giving birth. I hope you guys can help me..

1. Should I already use my husband's surname in the forms? All my ID's are still under my maiden name. Would it matter?

2. I'm filling for DCF should I use my Philippine or US address as the mailing address?

3. I've been living in the Philippines so I haven't filed for taxes in the US, what should I do? I have a co-sponsor who is above the poverty line though.

4. In the affidavit of support, can we put in my husband's bank statements in the assets even if it's in the Philippines?

5. Given that I haven't been staying much in the US, are my chances of getting approved for my family lessened by our current status?

I'm sorry for all my questions, I'm just very worried that we might have a lot of problems as we go along. Thank you everyone!

You should use your current surname. If you took his name at marriage, it is now YOUR surname, not just his. Get a new passport reflecting the new name.

2. I'm filling for DCF should I use my Philippine or US address as the mailing address?

To file DCF, you must live in the Philippines at the time of filing. You don't "use" addresses. You answer question literally. If you don't live in the P.I., you cannot file DCF.

3. I've been living in the Philippines so I haven't filed for taxes in the US, what should I do? I have a co-sponsor who is above the poverty line though.

Determine whether your income was above the filing threshold for any of the past three years. If it wasn't, don't file. For any year it was, you must file, regardless of whether you will qualify without a joint sponsor.

4. In the affidavit of support, can we put in my husband's bank statements in the assets even if it's in the Philippines?

Yes, but there's no point in doing so, unless they will help YOU qualify as the sponsor, without using a joint sponsor.

5. Given that I haven't been staying much in the US, are my chances of getting approved for my family lessened by our current status?

Being together with your husband improves your chances of success.

See direct answer is bold above. I'm confused though. How many children total? How many are your natural children and how many would be step children. Are your natural children US Citizens or qualify to be?

Thank you so much Sir! I truly appreciate your reply. We have 2 children together. First marriage for us both and we don't have children besides the 2 we have. They don't qualify for naturalization since I wasn't able to stay in the US for 1 year continuously so i still need to file for them. Thank yo very much Sir for answering my questions :)

Yes, you'll file three petition, one for each intending immigrant. The children however, will get the kind of IR-2 visa that results in citizenship upon entry, while your husband will qualify only for a green card. If you've been married for 2 years or more upon his entry, it will be full permanent resident status. If less than two years, it will be conditional status. See the CR1/IR1 guide for more details.

Yes, you'll file three petition, one for each intending immigrant. The children however, will get the kind of IR-2 visa that results in citizenship upon entry, while your husband will qualify only for a green card. If you've been married for 2 years or more upon his entry, it will be full permanent resident status. If less than two years, it will be conditional status. See the CR1/IR1 guide for more details.
