Good Morning! VJ Family I am in need of the most season VJ member or members to assist with this matter because, I am totally freaking out now :oops::help: We submitted the I-130 back in June 2015 we have received the NOA2 and now the paperwork is heading to NVC. Which everything is fine but, I am now worried after reading another member's post of their step children. I listed my stepson on my husband's application but, it seems that I should have submitted an whole separate application for my stepson as well. Can someone please let me know if this is true or not because, he is an minor only 10 years of age and if I was suppose to I've totally messed up and NEED HELP ASAP!!! to know what steps I need to take. Thank you in advance!! I'm hoping I am not stressing too much.

Yes, a separate petition needs to be filed for the child. File now and ask for an expedite (not sure one will be grated due to your error but you never know). In the mean time, delay the father's case at NVC

Yep, you'll need to submit a separate I-130 and petition for your step-son. As said above, you can request an expedite and wait until his petition is approved to continue processing your spouse's case at NVC.

Once the cases get to NVC, you can have them linked so interview date can be scheduled together.

OMG! I did not know......If I would continue on with my husband's process since it almost near can we file his once my husband is here?

Yes, a separate petition needs to be filed for the child. File now and ask for an expedite (not sure one will be grated due to your error but you never know). In the mean time, delay the father's case at NVC

Yeah, you can definitely do that. Make sure that you as a USC file because if your husband files then as a LPR, its a 2 year wait.

Al & Deidre, are you at nvc stage yet? I add my grandchild to the petition in june you will need birth certificate ,passport numberand expiration date.call nvc and they will give you more information my lawyer did the papers .

Good Afternoon! Yes, we are at the NVC stage paperwork should have reached there by now. I am not using a lawyer to cut cost. I did add him on the petition that I submitted for my husband but, once I received the NOA2 I got worried because, nothing came listed with his name just my husband's name. And that's when I got worried and made the inquire here on VJ.
